27. No tree trimming or pruning other than that specified in the tree report shall occur. <br />The project developer shall arrange for the horticultural consultant to conduct a <br />field inspection prior to issuance of grading permits to ensure that all <br />recommendations have been properly implemented. The consultant shall certify <br />in writing that such recommendations have been followed. <br />28. No existing trees shall be removed or impacted by the proposed development. <br />Prior to commencement of construction, the project developer shall install tree <br />protection fence, to the satisfaction of the Planning Director, at the dripline of the <br />existing trees on the subject site. <br />29. Prior to building final and prior to landscape installation, a final landscape and <br />irrigation plan for each lot shall be submitted for the review and approval of the <br />Planning Director and/or the City's Landscape Architect. Said landscape plan shall <br />be detailed in terms of species, location, size, quantities, and spacing. <br />30. All trees used in landscaping be a minimum of 15-gallons in size and all shrubs a <br />minimum of five-gallons, unless otherwise approved by the Planning Director with <br />the review of the landscape plan. <br />31. The project developer shall post cash, letter of credit, or other security satisfactory <br />to the Planning Director in the amount of $5,000.00 for each tree should any work, <br />utilities or otherwise, be conducted within an area in which potential impacts may <br />be anticipated. This cash bond or security shall be retained for one year following <br />acceptance of public improvements or completion of construction, whichever is <br />later, and shall be forfeited if the trees are destroyed or substantially damaged. In <br />the event any trees are destroyed or substantially damaged, an arborists' <br />assessment, at the developer's expense, shall be required to determine the value <br />of the damage or loss and the resultant sum paid to the City's Urban Forestry <br />Fund. <br />32. Landscaping installation time requirements: <br />a. Within 90 days of occupancy, all front and side yard, and common area <br />landscaping shall be installed, if any. <br />b. Within one year of occupancy, all rear yard landscaping shall be <br />installed. <br />Building Conditions: <br />33. The project developer shall obtain a building permit from the Building and Safety <br />Division and any other applicable City permits for the project prior to the <br />commencement of any construction. <br />7 <br />
