Ms. Decker added that they were checked by the Engineering staff to ensure the language was <br />incorporated into those documents. <br />In response Yo an inquiry by Commissioner Blank regarding whether the City had any liability if <br />that was not done, Ms. Harryman replied that the City probably had imnnulities. Commissioner <br />Blank requested that staff consider some mechanism, such as a check box or other follow-up, <br />that could be used to ensure that the disclosures were made. He noted that the Cily of San Diego <br />was recently sued for $4U million for approving a project that was allegedly later deemed illegal. <br />Commissioner Blank noted that he would like the words "including noise and vibration" added <br />to the Condition No. 27 regarding possible noise impacts due to overflying aircraft. Ms. Decker <br />suggested the following language: "...due to potential aircraft overflights, including but not <br />limited to noise and vibration." <br />Ms. Decker recommended that Condition No. 38 be amended to change the approved b~ulding <br />height from 25 feet to 30 feet, as noted iu the staff report and the Vineyard Avenue Corridor <br />Specific Plan. <br />Commissioner Blank moved to find that the proposed PUD development plan is consistent <br />with the General Plan and the Vineyard Avenue Corridor Specific Plan and the purposes <br />of the PUD ordinance; to make the PUD findings as listed in the staff report; and to <br />recommend approval of Casc PUD-60, subject to the development plan shown on Exhibit A <br />and to the conditions of approval listed in Exhibit B, as recommended by staff, with the <br />amendments to Condition No. 27 that the phrase "including Hoist and vibration" be added <br />to the aircraft overflight impact and to Condition No. 38 that the approved building height <br />be changed from 25 feet to 30 feet as provided in the Vineyard Avenue Corridor Specific <br />Plan. <br />Commissioner O'Connor seconded the motion. <br />ROLL CALL VOTE: <br />AYES: Commissioners Blank, Fos, O'Connor, and Pearce. <br />NOES: None. <br />ABSTAIN: None. <br />RECUSED: None. <br />ABSENT: Commissioner Olson. <br />Resolution No. PC-2007-06 recommending approval of PUD-60 was entered and adopted as <br />motioned. <br />EXCERPTS: PLANNING COMMISSION MEETING MINUTES, February 14, 2007 I'agc 2 of 2 <br />
