FIRST AMENll11ENT TO AGREEMENT PROVIDING FOR STABILIZATION OF <br />JIOBILEHOME SPACE RENTS <br />THIS FIRST AMEND?~1ENT TO "fHE AGREEiVfENT PROVIDING FOR THE <br />STABILIZATION OF MOB[LEHOIv4E PARK RENTS is made December 19, ?006 between <br />Edmund and Barbara Gil, Daniel Guggenheim, and Pleasanton Iacienda (collectively, Park <br />Owners) and the City of Pleasanton (City). <br />Recitals <br />A. On December 28, ?001 the Park Owners and the City entered into an Agreement <br />Providing for Stabilization of Mobilehome Rents (the Agreement) which Agreement establishes <br />the rents that may be charged for spaces at the Fairview Trailer Park, Vineyard Mobile Villa, and <br />the Hacienda Mobilehome Park. <br />B. The Agreement has a termination date of December 31, ?006. <br />C. Representatives of the Park Owners and of the City, along with residents of the <br />Parks, have discussed during ?006 terms and conditions for a revised Agreement but those <br />discussions have not yet resulted in such revised Agreement. <br />D. Without this proposed amendment to the Agreement, proposing to extend the term <br />of the Agreement to March 31, ?007, the Agreement will expire and the City's Mobilehome <br />Stabilization Ordinance would apply to rents in the three Parks, the application of which could <br />result in the rents being raised to existing residents. <br />E. By approving this First Amendment, no rent of any current resident within the <br />Parks will be affected. <br />NOW, THEREFORE, in consideration of the faithful performance of the terms, conditions, <br />covenants and promises set forth in the Agreement, as amended herein, the parties agree as <br />&~llows: <br />Section L Article lV, Paragraph C of the Agreement is amended to read as follows: <br />"[V. Establishment of Adjusted Monthly Rents and Rent Increases <br />(Paragraphs A and B, no change) <br />
