BACKGROUND <br />The Altamont Settlement Agreement, dated November 30, 1999 involved the County of <br />Alameda, the City of Livermore, the City of Pleasanton, Sierra Club, Northern California <br />Recycling Association, Altamont Landowners Against Rural Mismanagement and Waste <br />Management of Alameda County, Inc. The agreement established three committees, <br />one of which is the Community Monitor Committee (CMC). Funded by Waste <br />Management of Alameda County, Inc., this committee is comprised of four (4) voting <br />members, appointed by the following organizations: <br />• City of Livermore, <br />• City of Pleasanton, <br />• Sierra Club and <br />• Northern California Recycling Association. <br />Three non-voting members from Waste Management of Alameda County, Inc., Alameda <br />County and Altamont Landowners Against Rural Mismanagement also sit on the <br />committee. The CMC was tasked with the responsibility to retain a "Community <br />Monitor", technical expert(s) responsible for monitoring the Altamont Landfill and <br />Resource Recovery Facility's (ALRRF) compliance with environmental laws and <br />regulations, and advising the Cities of Livermore and Pleasanton on environmental and <br />technical issues related to the operation of the ALRRF. <br />The CMC selected TechLaw, Inc. as the Community Monitor. This firm began its review <br />of ALRRF operations in March of 2005 and concluded, after completing their 16-month <br />study, that there was overall compliance at ALRRF. TechLaw, Inc. stated that although <br />the firm conducted monthly inspections, inspections by the Local Enforcement Agency <br />(Alameda County) were more frequent (weekly). TechLaw also observed that issues <br />brought to ALRRF personnel were addressed in a timely manner. A letter dated July <br />16, 2006 from the TechLaw regional manager to the CMC Chair summarizes their <br />findings (Attachment A). <br />DISCUSSION <br />Both committee members appointed by the City of Livermore and the City of Pleasanton <br />resigned from the CMC in August 2006. Reasons cited by these former members <br />include the opinion that the work conducted by the Community Monitor was redundant <br />with the work performed by the Local Enforcement Agency representative. <br />(Attachments B and C). The Altamont Settlement Agreement does not contain <br />provisions to sunset either the CMC or the Community Monitor unless all parties to the <br />agreement were to concur; that is not the current situation. At the January 8, 2007 <br />Livermore City Council Meeting, Council Member Marjorie Leider was appointed to the <br />CMC as Livermore's representative.
