EXHIBIT B <br />CONDITIONS OF APPROVAL <br />2002 Valley Oak Road <br />PUD-89-15-18M <br />March 13, 2007 <br />1. The rear yard setback for the accessory structure approved as PADR-1073 <br />primary for this lot (2002 Valley Oak Road) shall conform to the site plan, Exhibit <br />A, dated "Received, February 7, 2007," on file with the Planning Department, <br />except as modified by the following conditions. Minor changes to the plan may <br />be allowed subject to the approval of the Planning Director if found to be in <br />substantial conformance to the approved exhibits, Exhibits A and B, inclusive. <br />2. The minimum setbacks for the accessory structure on the subject lot shall be <br />modified as follows: <br />Rear Yard Setback: 20 feet <br />3. All setbacks shall be measured from to the closest property line regardless of <br />the shape of the lot. <br />4. All grading restrictions required by the approved PUD plan must be adhered to. <br />5. No vehicle access shall be allowed through or on the open space designated <br />area. <br />6. Prior to issuance of a Building Permit, the applicant shall submit a landscape <br />plan, to the review and approval by the Planning Director, that ensures adequate <br />screening of the proposed accessory structure. <br />7. The accessory structure shall not be habitable. If the applicant wishes to change <br />this condition in the future, the applicant will be required to apply for all <br />applicable HOA and City approvals. <br />8. All conditions of approval for this case, PADR-1073, and PUD-85-15-15M shall <br />be reprinted and included as a plan sheet(s) with the building permit plan check <br />sets submitted for review and approval. These conditions of approval shall be <br />kept at all times at the project site. It is the responsibility of the applicant to <br />ensure that the project contractor is aware of, and abides by, all conditions of <br />approval. Prior approval from the Planning Department must be received before <br />any changes are constituted in site design, grading, building design, building <br />
