ATTACHMENT 1 <br />iFiE C.IiY ~JF <br />:. ,. <br />~y .~ <br />~ ~ ~ ; <br />a~ ~ _ A ~ • <br />.. ...._.. -..... .. ..._._. ..a...-.... _.... .... _ .... .. <br />March 13, 2007 <br />Dr. Ramsey Araj <br />2002 Valley Oak Road <br />Pleasanton, CA 94588 <br />Dear Mr. Araj: <br />RE: PUD-85-15-18M <br />The City has completed its review of your application for a minor modification to an approved <br />development plan, Case PUD-85-15-18M, to reduce the rear yard setback from the required <br />30 feet to 20 feet to allow the construction of an approximately 450-square-foot pool cabana <br />in the rear yard of the existing residence located at 2002 Valley Oak Road. <br />In accordance with City Council policy, notice of the proposed PUD minor modification was <br />sent to the surrounding property owners on March 2, 2007. No request was made for a formal <br />hearing. <br />Based upon the information submitted, it is my determination that the above changes are not <br />substantial in nature since the overall plan for the site will remain the same. Therefore, in <br />accordance with the provisions of Chapter 18.68 of the Municipal Code of the City of <br />Pleasanton, I am granting a minor modification, Case PUD-85-15-18M, subject to the following <br />conditions: <br />The proposed modifications shall conform substantially to the site plan and design <br />guidelines, Exhibit A, dated February 7, 2007, on file with the Planning Department. <br />2. The applicant shall obtain all required City permits for the structures prior to <br />construction. <br />3. Except, as modified by Conditions 1 and 2 above, all conditions of Cases PUD-85-15 <br />through PUD-85-15-17M shall remain in full force and effect. <br />In accordance with the PUD ordinance, notice of this approval is being sent to the Planning <br />Commission and City Council for their information. Any Planning Commission or City <br />Council member has twenty (20) calendar days from the date of approval of this letter to <br />appeal this decision if they so desire. Such an appeal would be subject to a public hearing <br />before the Planning Commission and City Council. <br />P. O.
