27. Except as otherwise conditioned, all trees used in landscaping shall be a minimum <br />of 15 gallons in size and all shrubs a minimum of 5 gallons. <br />28. Prior to occupancy, the landscape architect shall certify in writing to the Planning <br />Director that the landscaping has been installed in accordance with the approved <br />landscape and irrigation plans with respect to size, number, and species of plants <br />and overall design. <br />29. The project developer shall comply with the recommendations of the tree report <br />prepared by HortScience Inc. dated "Received" January 23, 2007. No tree <br />trimming or pruning other than that specified in the tree report shall occur. The <br />project developer shall arrange for the arborist to conduct a field inspection prior <br />to issuance of grading permits to ensure that all pre - construction recommendations <br />have been properly implemented. The arborist shall certify in writing to the City <br />that such recommendations have been followed. <br />30. The existing trees on the site shall not be removed. The project developer shall <br />post cash, letter of credit, or other security satisfactory to the Planning Director in <br />the amount of five thousand dollars ($5,000) for each tree required to be <br />preserved, up to a maximum of twenty -five thousand dollars ($25,000). This cash <br />bond or security shall be retained for one year following completion of <br />construction and shall be forfeited if the tree is removed, destroyed, or disfigured. <br />If the tree is removed, destroyed, or disfigured during construction, the applicants <br />shall pay a fine in the amount equal to the appraised value of the subject tree. If <br />the fine based on the appraised value of the tree(s) exceeds the bond amount, the <br />applicants shall pay the difference between the bond and the appraised value of the <br />subject tree(s). <br />31. Protective chain link or securely staked nylon fencing shall be installed around the <br />existing trees to be saved during all construction activities. The location of said <br />fencing shall be subject to the review and approval of the Planning Director. In <br />addition, the following tree preservation methods shall be followed: <br />a. The applicants shall utilize their best efforts to locate any new utility trenches <br />outside the dripline of the existing trees to be saved. If this is not feasible, then <br />the applicants shall submit a report from a certified arborist acceptable to the <br />City that indicates the trenching will not be detrimental to the health of the <br />trees. <br />b. No oil, gasoline, chemicals, or other harmful materials shall be deposited or <br />disposed within the dripline of the trees or in drainage channels, swales, or <br />areas that may lead to the dripline. <br />5 <br />
