Growth Management Plan, development of a logical contiguous <br />site such as the Garms parcel will preempt the demand for <br />leapfrog development beyond the developed fringe to sites <br />which are further up the Pleasanton Ridge or further out on <br />other fringes of the City further from adequate roads and <br />utilities than the Garms site. <br /> <br />Finally, the payment of the cancellation fee of 12 1/2% of <br />the fair market value will generate government revenues from <br />the Garms property well in excess of property taxes which <br />would have been received from the property. A portion of <br />the cancellation fees are directed to the Farmlands Mapping <br />Account of the State General Fund and another portion of the <br />cancellation fee is directed to the soil conservation <br /> <br />program. <br /> <br />B. That there is no proximate noncontracted land which is <br />both available and suitable for the use to which it is <br />proposed the contracted land be put, or, that development of <br />the contracted land would provide more contiguous patterns <br />of urban development than development of proximate <br />noncontracted land. <br /> <br />This is the same finding as the earlier finding under <br />paragraph 13 above. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: <br /> <br /> Council approves tentative cancellation of Williamson <br />Act Agricultural Preserve Contract 1975-7 under the <br />provisions of California Government Code Section 51282 <br />removing 117.94± acres of land located on the west side <br />of Foothill Road opposite West Las Positas Boulevard <br />from the Contract, subject to the following conditions: <br /> <br />ae <br /> <br />That the tentative cancellation of the <br />Agricultural Preserve Contract on the subject <br />property does not constitute any type of <br />development plan approval by the City and that any <br />development of the property shall be subject to <br />the standard development review procedures of the <br />City. <br /> <br />That the City Clerk be directed and authorized to <br />record a Certificate of Tentative Cancellation for <br />the property. <br /> <br />7 <br /> <br /> <br />
