RESOLUTION NO. <br />ATTACHMENT 2 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br />VACATING A PORTION OF THE RIGHT OF WAY ADJACENT TO THE REZNICK <br />PROPERTY, CREATING AN EASEMENT FOR PUBLIC UTILITIES AND <br />AUTHORIZING THE CITY MANAGER TO EXECUTE A QUITCLAIM DEED <br />WHEREAS, in 1970, right of way was dedicated to Alameda County (the right of way at <br />that time was in the unincorporated area of Alameda County) for future widening of the then <br />existing Vineyard Avenue adjacent to what is now the Reznick property (Lot 25 of the Vineyard <br />Avenue Corridor Specific Plan); and <br />WHEREAS, the right of way (and other property) were annexed to the City of <br />Pleasanton in the early 1990's; and <br />WHEREAS, such widening of the right of way did not occur and is not anticipated to <br />occur; and <br />WHEREAS, the City of Pleasanton does not need this right of way and a portion of this <br />right of way along the Reznick property, as depicted on the Platt Map and described in the Legal <br />Description for this strip of land, should be vacated; and <br />WHEREAS, it is the intention of the City Council to summarily vacate this right of way <br />pursuant to Chapter 4 of Part 3 of Division 9 of the California Streets and Highways Code as <br />this excess right of way has not been used as a street and is not needed for that purpose; the <br />use of this portion of what is now former Vineyard Avenue as a vehicular right of way in general <br />has been superseded by relocation of Vineyard Avenue; no property access will be terminated <br />by the vacation of this excess right of way; and <br />WHEREAS, the vacation of this right of way along the Reznick property is consistent <br />with the City's General Plan and the Vineyard Avenue Corridor Specific Plan; and <br />WHEREAS, the City desires to create a public utility easement for future utilities, the City <br />hereby retains such an easement; and <br />WHEREAS, as the original dedication of this right of way to Alameda County was in fee <br />title, title in the right of way vested in the City upon annexation and the City now desires to <br />quitclaim its interest in the right of way to the adjoining property owners. <br />NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br />PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br />SECTION 1. From and after the date that this resolution is recorded with the Alameda <br />County Recorder's Office, the right of way described in the legal description and plat map is <br />vacated and no longer constitutes a street or public right of way. <br />SECTION 2. The City Manager is authorized to execute a Quitclaim Deed quitclaiming <br />the City's interest in and to the property to Reznick, but reserving a public utility easement. <br />
