February 23, 2007 <br />Roger and Jane Manning <br />1300 Happy Valley Road <br />Pleasanton, CA 94566 <br />Dear Mr. and Mrs. Manning: <br />RE: PUD- 98 -16 -4M <br />ATTACHMENT 4 <br />The City has completed its review of your application for a minor modification to an approved <br />development plan, Case PUD- 98- 16 -4M, to reduce the right (south) side yard setback from the <br />required 7 feet to 5 feet and the combined side yard setback from the required 25 feet to 18 feet <br />for the construction of a custom home at 5270 Clubhouse Drive (Lot 14, Tract 7372). <br />In accordance with City Council policy, notice of the proposed PUD minor modification was <br />sent to the surrounding property owners on February 9, 2007. No request was made for a <br />formal hearing. <br />Based upon the information submitted, it is my determination that the above changes are not <br />substantial in nature since the overall plan for the site will remain the same. Therefore, in <br />accordance with the provisions of Chapter 18.68 of the Municipal Code of the City of <br />Pleasanton, I am granting a minor modification, Case PUD- 98- 16 -4M, subject to the following <br />conditions: <br />1. The proposed modifications shall conform substantially to the site plan and design <br />guidelines, Exhibit A, dated January 10, 2007, on file with the Planning Department. <br />2. The applicant shall obtain all required City permits for the structures prior to <br />construction. <br />3. Except, as modified by Conditions 1 and 2 above, all conditions of Cases PUD -98 -16 <br />through PUD- 98 -16 -3M shall remain in full force and effect. <br />In accordance with the PUD ordinance, notice of this approval is being sent to the Planning <br />Commission and City Council for their information. Any Planning Commission or City <br />Council member has twenty (20) calendar days from the date of approval of this letter to <br />appeal this decision if they so desire.
