February 23, 2007 Roger and Jane Manning 1300 Happy Valley Road Pleasanton, CA 94566 Dear Mr. and Mrs. Manning: RE: PUD- 98 -16 -4M ATTACHMENT 4 The City has completed its review of your application for a minor modification to an approved development plan, Case PUD- 98- 16 -4M, to reduce the right (south) side yard setback from the required 7 feet to 5 feet and the combined side yard setback from the required 25 feet to 18 feet for the construction of a custom home at 5270 Clubhouse Drive (Lot 14, Tract 7372). In accordance with City Council policy, notice of the proposed PUD minor modification was sent to the surrounding property owners on February 9, 2007. No request was made for a formal hearing. Based upon the information submitted, it is my determination that the above changes are not substantial in nature since the overall plan for the site will remain the same. Therefore, in accordance with the provisions of Chapter 18.68 of the Municipal Code of the City of Pleasanton, I am granting a minor modification, Case PUD- 98- 16 -4M, subject to the following conditions: 1. The proposed modifications shall conform substantially to the site plan and design guidelines, Exhibit A, dated January 10, 2007, on file with the Planning Department. 2. The applicant shall obtain all required City permits for the structures prior to construction. 3. Except, as modified by Conditions 1 and 2 above, all conditions of Cases PUD -98 -16 through PUD- 98 -16 -3M shall remain in full force and effect. In accordance with the PUD ordinance, notice of this approval is being sent to the Planning Commission and City Council for their information. Any Planning Commission or City Council member has twenty (20) calendar days from the date of approval of this letter to appeal this decision if they so desire.
