22.2 <br /> <br />Grievances shall be processed in the following manner: <br /> <br />(1) <br /> <br />within thirty (30) calendar days after the <br />occurrence of an event giving rise to a grievance, <br />an employee may request in writing to discuss the <br />grievance with such management official in the <br />department as the Police Chief may designate. <br /> <br />(2) <br /> <br />If the grievance remains unresolved the written <br />grievance may be filed with the Police Chief <br />who shall investigate the grievance and render <br />a decision within fourteen (14) calendar days from <br />the date the grievance is received. <br /> <br />(3) <br /> <br />Within fourteen (14) calendar days from receipt of <br />the Police Chief's decision in Step 2 above the <br />employee or official of the Association may notify <br />the Personnel Director in writing that a grievance <br />exists, statinc the particulars of the grievance, <br />citing the specific section of this Memorandum of <br />Understanding he/she believes to have been <br />violated, and, if possible, the nature of the <br />determination desired. The Personnel Director <br />shall have fourteen (14) days in which to <br />investigate the issues, meet with the complainant <br />and attempt to reach a satisfactory resolution of <br />the problem. No grievance may be processed under <br />paragraph (4) below which has not first been filed <br />and investigated in accordance with this paragraph <br /> (3). <br /> <br />(4) <br /> <br />If the parties are unable to reach a mutually <br />satisfactory accord on any grievance which arises <br />and is presented during the term of this Memorandum <br />of Understanding, such grievance shall be submitted <br />to an Review Board comprised of three (3) <br />Associatian representatives, no more than one (1) <br />of whom skall be an employee of the city, and three <br />(3) representatives appointed by the City Manager, <br />no more than one (1) of whom shall be an employee <br />of the City. <br /> <br />The Review Board shall be convened within twenty <br />one (21) calendar days from the day the grievance <br />was submitted to said Board. The Board shall <br />render its opinion in writing within fourteen <br />fourteen (14) calendar days from the date it <br />completed its review of the grievance. <br /> <br />(5) <br /> <br />If a Review Board is unable to arrive at a majority <br />decision, either the Association or the city may <br />require that the grievance be referred to an <br /> <br />Memorandum of Understanding <br />Page 23 <br /> <br /> <br />
