Box 52q <br />Pleasanton, CA 94566 <br /> <br />AGREEMENT TO GRANT REAL PROPERTY <br /> TO T~R CITY OF PLEASANTON <br /> <br /> THIS AGRE~ENTto grant real property is made and entered <br />into this day of , 1990, by and between <br />(hereinafter "Owner") and the CITY OF PLEASANTON (hereinafter <br />"City"). <br /> <br />WITNESSETH : <br /> <br /> A. The City of Pleasanton has proposed to make road and <br />associated improvements for Spring Street, Division Street, and <br />Railroad Street, including reconstructed street sections, new curb <br />and gutter, sidewalks, and installation of new water, sewer, and <br />storm drainage lines. Owner owns property located adjacent to <br />these streets, generally described as <br />ssds <br /> <br /> B. In order to make the proposed improvements, widening the <br />streets and/or sidewalks is necessary, and additional right-of-way <br />is required from Owner's property. <br /> <br /> C. As properties have redeveloped along these streets, <br />additional right-of-way and street improvement obligations have <br />been required, and City policy would require similar dedication <br />and improvement obligations in the future as properties <br />redevelop. <br /> <br /> D. Owner recognizes that the proposed street improvements <br />are a benefit to its property and that City's construction of <br />these improvements at no monetary cost to Owner relieves Owner of <br />a future obligation should its property be redeveloped. <br /> <br /> E. City recognizes that Owner's granting necessary right- <br />of-way in advance of potential redevelopment of its property <br />benefits City by allowing the full road improvements to be made. <br /> <br /> F. The City of Pleasanton has initiated an undergrounding <br />district for the area abutting Spring Street, Division Street, and <br />Railroad Street, more specifically described in City Resolution <br />88-206, Underground District No. 87-26, which would place all <br />existing overhead utilities underground. <br /> <br /> NOW, TK~RFORE, in consideration of the mutual covenants and <br />conditions herein, City and Owner agree as follows: <br /> <br /> 1. Grant of Real Property. Owner hereby grants to the City <br />of Pleasanton a strip of real property described as Parcel 1 in <br />the attached Exhibit "A" for street right-of-way and associated <br /> <br /> <br />
