CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 90-24 <br /> <br />RESOLUTION PERMITTING CITY OF Pr~ASANTON <br />TO JOINT IN AMICUS BRIEF <br /> <br />WHEREAS, <br /> <br />there is pending in the Second District Court of <br />Appeal of the State of California, the matter of <br />City of Simi Valley v. Superior Court, in which <br />important issues concerning inverse condemnation <br />will be decided; and <br /> <br />WHEREAS, <br /> <br />an adverse ruling to the City of Simi Valley may <br />result in a developer stating a cause of action <br />against a city for inverse condemnation without the <br />developer having applied to annex to, or develop <br />in, the city; and <br /> <br />WHEREAS, <br /> <br />the City Attorney for the cities of Bell and <br />Baldwin Park is writing the amici curiae (friends <br />of the court) brief in which other cities may join <br />at no cost; and <br /> <br />WHEREAS <br /> <br />the City Attorney has recommended to the City <br />Council that the City of Pleasanton be added to the <br />amici curiae brief, at no out of pocket expense to <br />the local taxpayers. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: <br /> <br /> The City Council hereby approves joinder of the <br />City of Pleasanton in the amici curiae brief of the <br />cities of Bell and Baldwin Park in the case of City <br />of Simi Valley v. Superior Court, pending in the <br />Second District Court of Appeal of the State of <br />California, such participation to be at no out of <br />pocket expense to the City of Pleasanton. <br /> <br />Section 2: This resolution shall become effective <br /> immediately upon its passage and adoption. <br /> <br /> <br />
