<br />ATTACHMENT 1 <br /> <br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. <br /> <br />RESOLUTION DENYING THE APPEAL (PAP-I02) OF THE <br />APPLICATION OF JOHN MILLER ARCHITECTS/SAINT <br />ELIZABETH SETON CHURCH AS FILED UNDER CASE NOS. <br />PDR-561/PV-158 <br /> <br />WHEREAS, on November 29, 2006, the Planning Commission approved applications <br />for: I) design review approval to modify the Saint Elizabeth Seton <br />Church Master Plan to construct an approximately 22,296-square-foot <br />parish center building with gymnasium and related site improvements on <br />the existing church site located at 4001 Stoneridge Drive; and 2) a <br />variance from the Municipal Code to allow the proposed parish center <br />building with gymnasium to be approximately 34-feet tall, where 30 feet is <br />the maximum height limit; and <br /> <br />WHEREAS, zoning for the property is A (Agriculture) District; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, Pleasanton <br />Village Association and Rohit and Sonia Gupta submitted an appeal (Case <br />PAP-I02) to the City of Pleasant on; and <br /> <br />WHEREAS, a duly noticed public hearing was held before the City Council on January <br />16,2007, at which time all pertinent testimony and documents were <br />reviewed; and <br /> <br />WHEREAS, actions of this nature are categorically exempt from the requirements of <br />the California Environmental Quality Act (CEQA); therefore, no <br />environmental document was prepared for this proposal; and <br /> <br />WHEREAS, after receiving public testimony and review of the materials presented, the <br />City Council determined that the proposed master plan modification and <br />parish center building design will not detrimentally affect the surrounding <br />properties. <br /> <br />WHEREAS, the City Council made the following findings: <br /> <br />1. That because of special circumstances applicable to the property, <br />including size, shape, topography, location or surroundings, the strict <br />application of the provisions of this chapter deprives such property of <br />privileges enjoyed by other properties in the vicinity and under <br />identical zoning classification; <br />
