<br />10 <br /> <br />ORDINANCE NO. 1946 <br /> <br />AN ORDINANCE APPROVING THE APPLICATION OF MICHAEL CALLAHAN FOR A <br />MAJOR MODIFICATION, AS FILED UNDER CASE PUD-93-02-8M <br /> <br />WHEREAS, Michael Callahan has applied for a major modification to the Ruby Hill PUD <br />development plan to allow the construction of an approximately 19,872-square-foot event center <br />with a 4,800-square-foot winery at the property located on the southwest comer of Vineyard and <br />Isabel Avenues, south of Ruby Hill Drive; and <br /> <br />WHEREAS, zoning for the property is PUD - LDR (Planned Unit Development - Low <br />Density Residential) District; and <br /> <br />WHEREAS, based on the Initial Environmental Study and pursuant to Resolution <br />No. 06-081, the City Council adopted a Negative Declaration for the proposed project on <br />December 19,2006; and <br /> <br />WHEREAS, pursuant to Resolution No. 06-081, the City Council approved the <br />application of Michael Callahan for a conditional use permit to allow: (1) the operation of an <br />event center and winery at the property located on the southwest comer of Vineyard and Isabel <br />Avenues, south of Ruby Hill Drive; and (2) alcoholic beverage service at the event center after <br />10:00 p.m.; and <br /> <br />WHEREAS, the City Council received the Planning Commission's positive <br />recommendations for approval of the PUD development plan modification for the subject site; <br />and <br /> <br />WHEREAS, the City Council finds that the PUD modification is consistent with the <br />General Plan and the purposes of the PUD ordinance of the City of Pleasanton. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br /> <br />Section 1. Approves Case PUD-93-02-8M, the application of Michael Callahan for a <br />major modification to the Ruby Hill PUD development plan to allow the construction of an <br />approximately 19,872-square-foot event center with a 4,800-square-foot winery at the <br />property located on the southwest comer of Vineyard and Isabel Avenues, south of Ruby <br />Hill Drive, subject to the conditions shown on Exhibit S, attached hereto and <br />incorporated herein by this reference. <br /> <br />Section 2. A summary of this ordinance shall be published once within <br />fifteen (15) days after its adoption in "The Valley Times," a newspaper of general <br />circulation published in the City of Pleasanton, and the complete ordinance shall be <br />posted for fifteen (15) days in the City Clerk's office within fifteen (15) days after its <br />adoption. <br /> <br />Section 3. This ordinance shall be effective thirty (30) days after its passage and <br />adoption. <br />
