CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, GALIFORNIA RESOLUTION NO. 90-11 RESOLUTION DENYING THE APPEAL OF THE CITY COUNCIL FROM A DECISION OF THE PLANNING COMMISSION AND APPROVING THE APPLICATION OF SPEEDEE OIL CHANGE AND TUNE-UP/HAMNRR/NELSON AS FI?mDUNDERAP-90-1 (CASE UP-89-57) WHEREAS, at its meeting of December 13, 1989, the Planning Commission approved Case UP-89-57, the application of SpeeDee Oil Change and Tune-Up/Hammer/Nelson for a conditional use permit to operate an automobile oil change and preventive maintenance service facility to be located on an approximately 0.56 acre site located at 44 Mission Drive and determined that the proposed use fell within the "service station" definition of the zoning ordinance thus making rezoning unnecessary; and WHEREAS, zoning for the property is C-F (Freeway Commercial) District; and WHEREAS, within the time specified by the Pleasanton Municipal Code, the City Council submitted an appeal to the City Clerk of the City of Pleasanton; and WHEREAS, a public hearing was held before the City Council on January 16, 1990 at which time all pertinent testimony and documents were reviewed; and WHEREAS, a Negative Declaration was prepared for the rezoning and conditional use permit applications; the Planning Commission considered the environmental document and further review is not necessary at this time; and WHEREAS, the City Council finds this project consistent with the purposes of the C-F Zoning District. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1. The appeal of the Planning Commission decision is denied and therefore the application of SpeeDee Oil Change and Tune-Up/Hammer/Nelson for a conditional use permit to operate an automobile oil change and preventive maintenance service facility to be located on a approximately 0.56 acre site located at 44 Mission Drive, subject to the attached conditions, is approved.
