<br />ORDINANCE NO. 1944 <br /> <br />AN ORDINANCE APPROVING THE APPLICATION OF MIKE RENQUIST FOR <br />PLANNED UNIT DEVELOPMENT MAJOR MODIFICATION, AS FILED UNDER <br />CASE PUD-D1-D9M <br /> <br />WHEREAS, Mike Renquist has applied for a major modification to an approved <br />Planned Unit Development (PUD) to increase the maximum building height from 23 feet <br />to 26 feet, to allow a barrel tile roof, and to allow design review approval by the Planning <br />Director for a single lot located at 2511 Yolanda Court in the Vineyard Avenue Corridor <br />Specific Plan area; and <br /> <br />WHEREAS, zoning for the property is PUD-LDR (Planned Unit Development - <br />Low Density Residential) District; and <br /> <br />WHEREAS" the environmental review for this proposed project was undertaken <br />with an Initial Study Mitigated Negative Declaration approved by the City Council for <br />PUD-01 on March 6, 2001, in conformance with the standards of the California <br />Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, there are no substantial changes to the project or to the <br />circumstances under which the project is being undertaken that involve new significant <br />environmental effects or that substantially increase the severity of previously identified <br />effects; furthermore, there is no new information of substantial importance which was <br />unknown at the time that the Mitigated Negative Declaration was approved by the City <br />Council regarding the project or its effects, mitigation measures, or alternatives; and any <br />previously identified effects or impacts are mitigated to a level of insignificance with the <br />mitigation measures incorporated into the project's design or imposed on the project <br />pursuant to the conditions of approval; and <br /> <br />WHEREAS, at its meeting of October 25, 2006, the Planning Commission <br />recommended approval of the modification to the PUD development plan; and <br /> <br />WHEREAS, a duly noticed public hearing was held on December 5, 2006; and <br /> <br />WHEREAS, the City Council finds that the PUD major modification is consistent <br />with the General Plan policies and the purposes of the PUD ordinance of the City of <br />Pleasanton; and <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />DOES HEREBY ORDAIN AS FOLLOWS: <br /> <br />Section 1. Approves Case PUD-01-09M, the application of Mike Renquist for a <br />major modification to an approved Planned Unit Development (PUD) to increase the <br />maximum building height from 23 feet to 26 feet, to allow a barrel tile roof, and to allow <br />design review approval by the Planning Director for a single lot located at 2511 Yolanda <br />Court in the Vineyard Avenue Corridor Specific Plan area, subject to the conditions <br />shown on Exhibit 8, attached hereto and incorporated herein by this reference. <br />
