RESOLUTION NO. 06-081 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, APPROVING A NEGATIVE DECLARATION FOR THE APPLICATION OF MICHAEL CALLAHAN FOR A MAJOR MODIFICATION TO THE RUBY HILL PUD DEVELOPMENT PLAN, AS FILED UNDER CASE PUD-93-02-8M WHEREAS, at its meeting of December 19, 2006, the City Council received a proposed Negative Declaration for the application of Michael Callahan for a major modification to the Ruby Hill PUD development plan to allow the construction of an approximately 19,872-square-foot event center with a 4,800-square-foot winery at the property located on the southwest comer of Vineyard and Isabel Avenues, south of Ruby Hill Drive; and WHEREAS, the City Council received and reviewed the Initial Study, dated September 13, 2006 and received the recommendations of staff and the Planning Commission; and WHEREAS, a duly noticed publiC hearing was held on December 19, 2006, at which time the public was given the opportunity to comment on the environmental impacts of the proposed project; and WHEREAS, the City Council has reviewed the potential impacts in accordance with the applicable state and local guidelines governing the preparation of Negative Declarations and Environmental Impact Reports; and WHEREAS, the City Council finds that the proposed project would not have any significant adverse effects on the environment; and WHEREAS, the City Council further finds that the proposed project will have no potential for adverse impacts on the site's wildlife. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1. Approves the Negative Declaration for the application of Michael Callahan for a major modification to the Ruby Hill PUD development plan to allow the construction of an approximately 19,872-square-foot event center with a 4,800-square-foot winery at the property located on the southwest corner of Vineyard and Isabel Avenues, south of Ruby Hill Drive. Section 2. The City staff is directed to cause a Notice of Determination to be filed pursuant to Section 5.4(g) of Resolution No. 77-66. Section 3. This resolution shall become effective immediately upon its passage and adoption.
