CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 92-208 <br /> <br />RESOLUTION DENYING THE APPEAL OF THE CITY <br />COUNCIL THEREBY UPHOLDING THE CONDITIONAL <br />APPROVAL OF THE PLANNING COMMISSION TO ALLOW <br />RETENTION OF ANEXISTING PAVILION AND DECK AT <br />2943 VICTORIA~6R. ADOW COURT (AP-92-13/Z-92-49) <br /> <br />WHEREAS, <br /> <br />at its meeting of September 23, 1992, the Planning <br />Commission approved Case Z-92-49, the application of Andy <br />Salmon for design review approval to retain an existing <br />238 sq. ft. pavilion with a deck, approximately 11 feet <br />in height, located at 2943 Victoria Meadow Court; and <br /> <br />WHEREAS., <br /> <br />zoning .for the propcrty is PUD - MDR (Planned Unit <br />Development - Medium Density Residential) District; and <br /> <br />WHEREAS, <br /> <br />within the time specified by the Pleasanton Municipal <br />Code, the City Council appealed the decision in order to <br />further review the matter; and <br /> <br />WHEREAS, <br /> <br />a public hearing was held before the City Council on <br />November 3, 1992, at which time all pertinent testimony <br />and documents were reviewed; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: Denies the appeal of the Council (AP-92-13) thereby <br /> upholding the Planning Commission approval of the <br /> application of Andy Salmon for design review approval of <br /> an existing 238 sq. ft. pavilion with a deck, <br /> approximately 11 feet in height, located at 2943 Victoria <br /> Meadow Court (Z-92-49), subject to the conditions as <br /> modified by the City Council and as set forth on the <br /> attached exhibit. <br /> <br />Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
