Box 520 <br />Pleasanton, CA 94566 <br /> <br />AGREEKENT CONCERNING REGRADING AND CONSTRUCTION <br /> <br /> THIS AG~R~NT concerning regrading and construction is made <br />this day of , 1992, by and <br />between Charles and Joan Suer, 949 Montevino Drive, Pleasanton, <br />California ("Owners") and the City of Pleasanton, a Municipal <br />Corporation ("City") as follows: <br /> <br />RECITALS <br /> <br /> WHEREAS, Owners are the owners of certain real property in <br />the City of Pleasanton commonly known as 949 Montevino Drive, <br />Pleasanton, California and more particularly described as <br />follows: <br /> <br />(Hereafter, Lot 3 of Tract 5849 will be referred to as "the <br />Property.") <br /> <br /> WHEREAS, the Property is one of the twelve lots which abut <br />the adjacent Vintage Hills subdivision to the west; and <br /> <br /> WTnzREAS, as such, City identified the Property as an impact <br />lot and placed certain restrictions on the Property so as to <br />reduce any adverse impacts the development of the Property would <br />have on the privacy of adjacent residents in the Vintage Hills <br />subdivision; and <br /> <br /> WHEREAS, the Conditions, Covenants and Restrictions (CC&R's) <br />for Tract 5849, recorded , prohibit the <br />regrading of individual lots, including the Property, without <br />City approval; and <br /> <br />- 1 - <br /> <br /> <br />
