<br />RESOLUTION NO. 06-069 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON DENYING THE <br />APPEAL OF CASE PADR-13381 PV-131, THEREBY UPHOLDING THE PLANNING <br />COMMISSION'S DENIAL OF THE APPLICATION OF DUSTIN AND ROBIN BOYCE FOR <br />ADMINISTRATIVE DESIGN REVIEW APPROVAL AND VARIANCES FROM THE <br />PLEASANTON MUNICIPAL CODE, AS FILED UNDER CASE PAP-101 <br /> <br />WHEREAS, Dustin and Robin Boyce have applied for: (1) administrative design review <br />approval to demolish approximately 470 square feet of the existing home and to construct an <br />approximately 2,222-square-foot two-story addition, an approximately 833-square-foot <br />non-habitable basement, and an approximately 950-square-foot detached garage; and <br />(2) variances from the Pleasanton Municipal Code to: (a) increase the floor area ratio (FAR) <br />from 40 percent to 45 percent; (b) reduce the right (south) side yard setback from 5 feet to the <br />existing 3.85 feet; and (c) increase the height of the garage from 15 feet to 20.5 feet at the <br />property located at 4546 Second Street; and <br /> <br />WHEREAS, zoning for the property is R-1-6,500 (Single-Family Residential) District; and <br /> <br />WHEREAS, at its meeting of September 27, 2006, the Planning Commission, after <br />having considered all public testimony, relevant exhibits, and recommendations of City staff <br />concerning this application, denied the application; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, the appellants <br />submitted an appeal of the decision of the Planning Commission to the City Council; and <br /> <br />WHEREAS, at its meeting of October 17, 2006, the City Council received a report from <br />the Director of Planning and Community Development, together with a copy of the staff report to <br />the Planning Commission, regarding this matter; and <br /> <br />WHEREAS, the City Council held a public hearing on October 17, 2006, at which time <br />the appellants and members of the public were offered an opportunity to present evidence <br />regarding this appeal; and <br /> <br />WHEREAS, after a review of the materials presented, the City Council was not able to <br />make the findings for the proposed variances and determined that the proposed design is not <br />appropriate for the site. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Pleasanton <br />the following: <br /> <br />Section 1. Denies, without prejudice, the appeal, Case PAP-1 01, thereby upholding the <br />decision of the Planning Commission denying Case PADR-1338/ PV-131, the <br />application of Dustin and Robin Boyce for (1) administrative design review approval to <br />demolish approximately 470 square feet of the existing home and to construct an <br />approximately 2,222-square-foot two-story addition, an approximately 833-square-foot <br />non-habitable basement, and an approximately 950-square-foot detached garage; and <br />(2) variances from the Pleasanton Municipal Code to: (a) increase the floor area <br />ratio (FAR) from 40 percent to 45 percent; (b) reduce the right (south) side yard setback <br />
