CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 91-196 <br />RESOLUTION APPROVING POLICY REGARDING DELIVERY <br />OF AGENDA MATERIAL TO CITY COUNCIL <br />WHEREAS, at its meeting of November 19, 1991, the Assistant City <br />Manager presented a report (SR 91:474) regarding policies <br />for delivery of agenda material to the City Council; <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br />Section 1: The following policies are adopted regarding delivery <br />of agenda material to City Council <br />1. Any request made by the general public to have an <br />item placed on the City Council Agenda must be <br />received by the City Clerk no later than 13 days <br />prior to the date of the regularly scheduled <br />Council meeting. <br />(Staff procedures currently require submittal of <br />draft staff reports to the City Manager for review <br />two Fridays prior to any City Council meeting. <br />Establishing a time table for receipt of agenda <br />requests assures that staff has sufficient time to <br />research and prepare materials and assures that all <br />agenda items receive a full review prior to <br />presentation to the Council). <br />2. The City Council shall not consider requests to <br />place items on the City Council Agenda after the <br />agenda has been posted unless the Council <br />determines that the item arose after the agenda was <br />posted or that an emergency situation exists. <br />(The Ralph M. Brown Act prohibits the City Council <br />from taking action on items not on the posted <br />agenda unless the City Council determines that the <br />item arose after the agenda was posted or that an <br />emergency situation exists. In addition, as <br />previously indicated, for the benefit of the public <br />and all parties involved, it is necessary to <br />undertake staff research and to allow the City <br />Council an opportunity to thoroughly review related <br />materials including a City staff report prior to <br />making a decision.) <br />
