CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 91-189 <br />RESOLUTION PERMITTING CITY OF PLEASANTON TO <br />JOIN IN AMICUS BRIEF <br />WHEREAS, there is pending in the U.S. Supreme Court the matter of <br />Yee v. City of Escondido, in which important issues <br />concerning whether a governmental regulation effects a <br />taking of private property; and <br />WHEREAS, an amicus curiae (friend of the court) brief is being <br />written in which other cities may join at no cost; and <br />WHEREAS, the City Attorney has recommended to the City council <br />that the City of Pleasanton be added to the amicus curiae <br />brief, at no out-of-pocket expense to the local <br />taxpayers. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br />Section 1: The City Council hereby approves joinder of the City <br />of Pleasanton in the amicus curiae brief in the case of <br />Yee v. City of Escondido, pending in the U.S. Supreme <br />Court, such participation to be at no out-of-pocket <br />expense to the City of Pleasanton. <br />Section 2: This resolution shall become effective immediately <br />upon its passage and adoption. <br />I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON NOVEMBER 19, 1991 BY THE FOLLOWING VOTE: <br />AYES: Councilmembers - Butler, Mohr, Scribner, Tarver, and <br />Mayor Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />APPROVED AS TO FO <br />Michael H.
