CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 91-181 <br />RESOLUTION AMENDING THE FORM OF THE GROWTH <br />MANAGEMENT AGREEMENTS FOR 1992 <br />WHEREAS, on July 16, 1991, the City Council adopted Resolution No. <br />91-106, granting growth management approval to six <br />projects; and <br />WHEREAS, said resolution also provided that no building permits <br />would be issued for any of the projects if mandatory <br />water rationing is in effect; and <br />WHEREAS, City Council is considering a number of water offset <br />programs, the purpose of which would be to promote <br />efficient water consumption and water conservation; and <br />WHEREAS, if such a program is adopted and a project developer <br />participates, then under certain circumstances it may be <br />appropriate for building permits to be issued, even if <br />mandatory water rationing is in effect. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br />Section l: Resolution No. 91-106 is amended as follows: <br />Subsection c of Section 4 is hereby amended to read as <br />follows: <br />"This Resolution also does not guarantee the availability <br />of sufficient water to serve the Project. The City shall <br />withhold building permits for a Project if, at the time <br />building permits are applied for, mandatory water <br />rationing is in effect, unless the City has adopted a <br />water offset program and unless the Developer is <br />participating in the program. Notwithstanding the <br />Developer's participation in such program, the City may <br />withhold building permits if the City determines that <br />sufficient water is not available at the time building <br />permits for the Project are applied for." <br />Section 2: The language in Section 1 shall be included in all <br />Growth Management Agreements for projects approved in <br />1992, in the Ruby Hill Preannexation Agreement, and in an <br />amended Growth Management Agreement for PUD-81-30-52D. <br />
