CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 91-169 <br />RESOLUTION DENYING WITHOiJT PREJUDICE THE <br />APPEAL OF JAMES GRIFFEN (CASE AP-91-07) <br />THEREBY UPHOLDING THE DENIAL OF CASE UP-91-20 <br />BY THE PLANNING COMMISSION <br />WHEREAS, at its meeting of August 28, 1991, the Planning <br />Commission denied, without prejudice, Case UP-91-20, the <br />application of James Griffen for a conditional use permit <br />to construct an approximately 950 square foot detached <br />secondary unit to be located at 1 Roman Eagle Court; and <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />- Low Density Residential/Open Space District; and <br />WHEREAS, within the time specified by the Pleasanton Municipal <br />Code, the applicant submitted an appeal to the City Clerk <br />of the City of Pleasanton; and <br />WHEREAS, a public hearing was held before the City Council on <br />October 1, 1991, at which time all pertinent testimony <br />and documents were reviewed; <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br />Section 1: Denies Case AP-91-07 without prejudice, thereby <br />upholding Planning Commission denial, without prejudice, <br />of Case UP-91-20, the application of James Griffen for a <br />conditional use permit to construct an approximately 950 <br />square foot detached secondary unit to be located at 1 <br />Roman Eagle Court. <br />Section 2: This resolution shall become effective immediately <br />upon its passage and adoption. <br />I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON OCTOBER 1, 1991 BY THE FOLLOWING VOTE: <br />AYES: Councilmembers - Butler, Scribner, Tarver, and Mayor <br />Mercer <br />NOES: None <br />ABSENT: Councilmember Mohr <br />ABSTAIN: None <br />ATTEST: <br />Peg Ezidr City Clerk <br />APPROVED AS TO FORM: <br />~~~~~~GGC~ ~ G~%~~. <br />Michael H.
