facility construction fees and charges. DSRSD shall determine <br />whether the maintenance and operations costs for the plant shall <br />be borne solely by the users of the plant or by all users of <br />DSRSD facilities. In the event that sewerage system fees and <br />charges are subsequently collected by the City from other <br />properties in the Territory served by the new separate treatment <br />plant, such fees and charges will be reimbursed to Developer pro <br />rata. <br />C. In the event that the City elects to cause <br />Developer to utilize sewer hook-ups to the City's existing sewer <br />system, Developer shall be responsible for those sewer connection <br />fees normally charged to users within DSRSD and Developer shall <br />in addition pay a capital fee. This capital fee shall be based <br />on the cost of construction of a treatment plant on site, built <br />to the standards identified in the Black and Beatch Report dated <br />April, 1991, and/or to the standards of any local, state or <br />federal regulatory agency, less (a) the sewer connection fees as <br />then set forth in Title 15 (Sewerage) of the Pleasanton Municipal <br />Code and (b) the costs of the off site work associated with the <br />physical connection of the Project to the City's existing sewer <br />system. With respect to the payment of the sewer connection fees <br />required by Title 15 (Sewerage) of the Pleasanton Municipal Code, <br />Developer shall pay to City $425,000 at the time of the approval <br />of the first final map for the Project, which sum represents the <br />City's portion of the sewer connection fees; Developer shall pay <br />[Draft 8/1/91] 9 <br />
