DSRSD shall determine whether the maintenance and operations costs for the plant shall be borne solely by the users of the plant or by all users of DSRSD facilities. In the event that sewerage system fees and charges are subsequently collected by the City from other properties in the Territory served by the new separate treatment plant, such fees and charges will be reimbursed to Developer pro rata. C. In the event that the City elects to cause Developer to utilize sewer hook-ups to the City's existing sewer system, Developer shall be responsible for those sewer connection fees normally charged to users within DSRSD and Developer shall in addition pay a capital fee. This capital fee shall be based on the cost of construction of a treatment plant on site, built to the standards identified in the Black and Beatch Report dated April, 1991, and/or to the standards of any local, state or federal regulatory agency, less (a) the sewer connection fees as then set forth in Title 15 (Sewerage) of the Pleasanton Municipal Code and (b) the costs of the off site work associated with the physical connection of the Project to the City's existing sewer system.
