CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 91-163 RESOLUTION APPROVING A PRE-ANNEXATION AGREEMENT WITH SIGNATURE PROPERTIES REGARDING THE RUBY HILL PROJECT WHEREAS, at its meeting of September 17, 1991, Council reviewed the proposed pre-annexation agreement with Signature Properties regarding the Ruby Hill project; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Approves the pre-annexation agreement as set forth in the Staff Report with the following modifications, to be approved in final form by the City Attorney: (1) Developer shall be permitted to construct 175 units in 1993 and 175 units in 1994 as set forth in Paragraph 13, with the balance of the units to be considered at the time growth management allocations are made in 1992 and (2) the "Water Service" section is to be amended to reflect that if the city has adopted a water conservation plan or program in which the Developer participates, Developer may be able to obtain building permits notwithstanding mandatory water rationing in the City. Section 2: Staff is directed to initiate implementation of a Sphere of Influence amendment which would include the entire 1,600 acre area. Section 3: Staff is directed to initiate annexation procedures for the entire 1,600 acre area using annexation Option 1 (through the Vineyard Avenue corridor). section 4: This resolution shall become effective immediately upon its passage and adoption.
