CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 91-160 <br />RESOLUTION APPROVING A NEGATIVE DECLARATION <br />FOR THE APPLICATION OF ARTHUR DUNRLEY, GREGORY <br />MIX, AND HOWARD HANSEN FOR REZONING AND <br />DEVELOPMENT PLAN APPROVAL AS FILED UNDER CASE <br />PUD-91-4 <br />WHEREAS, at its meeting of September 17, 1991, the City Council <br />received a proposed negative declaration for the <br />application of Arthur Dunkley, Gregory Mix, and Howard <br />Hansen for rezoning to the PUD (Planned Unit Development) <br />- Service Commercial and Office District and development <br />plan approval to allow a combination of commercial and <br />office uses on a developed and vacant site totaling <br />approximately 2.22 acres located at 63 and 73 Ray Street; <br />and <br />WHEREAS, the City Council has received and reviewed the Initial <br />Study dated August 28, 1991 and received the <br />recommendations of the staff and Planning Commission; and <br />WHEREAS, a duly noticed public hearing was held at which time the <br />public was given the opportunity to comment on the <br />environmental impacts of the proposed rezoning and <br />development plan; and <br />WHEREAS, the City Council has reviewed the potential impacts in <br />accordance with the applicable state and local guidelines <br />governing the preparation of Negative Declarations and <br />Environmental Impact Reports; and <br />WHEREAS, the City Council finds that the proposed rezoning and <br />development plan would not have any significant adverse <br />effects on the environment; and <br />WHEREAS, the City Council further finds that the proposed project <br />will have not potential for adverse impacts on the site's <br />wildlife; <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br />Section 1: Approves the Negative Declaration for the application <br />of Arthur Dunkley, Gregory Mix, and Howard Hansen for <br />rezoning to the PUD (Planned Unit Development) - Service <br />Commercial and Office District and development plan <br />approval to allow a combination of commercial and office <br />uses on a developed and vacant site totaling <br />approximately 2.22 acres located at 63 and 73 Ray Street. <br />
