approved by the City, to maintain, repair and inspect <br />those systems. Such maintenance contract shall provide <br />that the contractor file with the City Engineer semi- <br />annually or annually a report certifying that those <br />systems are in good repair and being properly <br />maintained. The Contractor shall report all problems, <br />wear and tear on the systems, and expected future <br />service needs; and <br />b. that the City shall be named as a beneficiary of said <br />CC&R's and granted the power to enforce its provisions <br />if the homeowners association fails to do so. <br />29. The private streets shall be paved and provide a driving <br />surface of not less than 28 ft. of unobstructed width, be <br />capable of supporting the imposed loads of fire apparatus, <br />and have a minimum of 13 ft. 6 in. of vertical clearance. <br />The final design o€ all project roadways and driveways shall <br />be included in the tentative map submittal. The private <br />streets as shown on the development plan shall be <br />constructed with 6 in. vertical concrete curb and gutter <br />unless otherwise approved by the City Engineer. Parking <br />shall be allowed on only one side of the street in areas of <br />minimum 28 feet width and shall be signed to allow City <br />enforcement if necessary. <br />30. All roadway and on-site drainage ditches installed shall be <br />constructed of concrete. <br />31. Storm drain swales, gutters, V-ditches, channels, natural <br />ravines not within the area of a dedicated public street or <br />public service easement approved by the City Engineer shall <br />be privately maintained by the property owners or though an <br />Association approved by the City. <br />32. Should evidence of any archaeological site be uncovered <br />during any phase of project construction, work shall cease <br />until a qualified archaeologist has reviewed the site and <br />made recommendations concerning the disposition of the site. <br />All mitigation measures required by the Planning Director <br />following receipt of the archaeologist's recommendations <br />shall be conditions of this approval. <br />33. Perimeter fencing on each lot shall be of one open-type <br />design. Closed-type fencing and walls can be utilized <br />within the building setback area subject to Design Review <br />Board approval. <br />34. Only the east facing slope of Lot 4 (alternative 3) shall <br />be utilized as a building site unless further geologic <br />analysis is conducted, and determined to be satisfactory by <br />the City's reviewing geologist, which establishes the flat, <br />western portion of Lot 4 as an acceptable building site. <br />
