8/23/89 <br />Exhibit "A" <br />Conditions of Approval <br />UP-89-31 <br />Resolution No. PC-89-74 <br />1. The project shall be an interim park and ride/heliport <br />facility; this permit shall be reviewed in five years by the <br />Planning Director who shall determine whether to renew the <br />permit under the same conditions of approval or refer the <br />issue to the Planning Commission for a determination of <br />whether the interim use may continue. <br />2. The heliport facility shall be operated essentially as <br />outlined in the "Hacienda Business Park Heliport Statement of <br />Proposed Operation," dated January 19, 1989; any significant <br />deviation shall require prior review and approval by the <br />Planning Commission. <br />3. All required permits from state and federal agencies shall be <br />secured prior to construction of the heliport, with copies of <br />some submitted for planning staff review; all such permits <br />shall remain in effect for the entire time the heliport is in <br />operation. <br />4. Should regularly scheduled cargo and/or regularly scheduled <br />passenger service be instituted, or any other facility added <br />to the heliport, the Planning Director may review the permit <br />conditions administratively and incorporate such additional <br />conditions as may be required to ensure the operation is not <br />detrimental to the public health, safety, or welfare. <br />5. Any deviation from the designated approach-departure paths <br />shown on the plan shall be cause for review and possible <br />revocation of the use permit. <br />6 No fuel transfer or storage shall be allowed on the site; all <br />requirements of the Pleasanton Fire Department shall be met <br />in project design and operation. <br />7. In the event BART acquires this site, Prudential shall not <br />seek reimbursement for any of the interim improvements not <br />readily usable to and valuable for BART in conjunction with <br />its plans for the site; this condition reflects the <br />applicant's understanding that the improvements are interim <br />in nature, are not designed for long-term use, and would not <br />add value to the site in the event of a sale to another user <br />(similar to the existing interim heliport improvements), and <br />the applicant's desire to encourage BART to extend <br />its facilities to the planned Hacienda station as soon as <br />possible. <br />8.
