<br />PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION N0. PC-89-66 <br />RESOLUTION RECOMMENDING APPROVAL OF AN AMENDMENT TO <br />SECTION 18.12 OF THE MUNICIPAL CODE <br />WHEREAS, the City has applied to amend the Municipal Code <br />relative to designation of Director of Building <br />Inspection duties and responsibilities within the Zoning <br />Ordinance; and <br />WHEREAS, at their duly noticed public hearing of June 14, 1989, <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br />WHEREAS, minor changes to the Municipal Code are categorically <br />exempt from CEQA. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br />Section 1. Recommends approval of Cas RZ-89-5, amending the <br />following sections of the Municipal Code be amended in <br />their entirety: <br />18.12.020 Duties of city officials. <br />The director of building inspection and zoning <br />administrator shall be the official responsible for the <br />enforcement of this title; The director of building <br />inspection and zoning administrator, or their deputies, <br />shall have the right to enter on any site or to enter <br />any structure for the purpose of investigation and <br />inspection related to any provision of this title; <br />provided, that the right of entry shall basexshalleany <br />only at reasonablred insthedabsencenofothe owner or <br />structure be ente <br />tenant without the written order of a court competent <br />jurisdiction. The director of building inspection <br />or zoning administrator may serve notice requiring the <br />removal of any structure or use in violation of the <br />regulations on the owner or his authorized agent, on a <br />tenant, or on an architect, builder, contractor, or <br />other person who commits or participates in any <br />violation. The director of building inspection or the <br />zoning administrator may call upon the city attorney to <br />institute necessary legal proceedings to enforce the <br />provisions of this title, and the city attorney is <br />authorized to institute appropriate actioninto that end. <br />The director of building inspection or zon g <br />administrator may call upon the chief of police and his <br />
