PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION N0. PC-89-54 <br />RESOLUTION WITH REGARD TO REVIEW OF CONDITIONAL USE <br />PERMIT UP-86-7, KENNETH BEST <br />WHEREAS, in April 26, 1989 Mr. Best was granted a use permit for, <br />among other uses, storage of impound vehicles at 3700 <br />Boulder Street; and <br />WHEREAS, in February 1989, staff investigated dismantling/salvage <br />operations taking place on the site with spillage of <br />hazardous substances on the unpaved portion of the site. <br />This investigation has led to staff's referral of this <br />matter to the Planning Commission for review and <br />possible revocation of portions of Mr. Best's <br />conditional use permit; and <br />WHEREAS, at their duly noticed public hearing of May 10, 1989, <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br />WHEREAS, the Planning Commission found that automobile <br />dismantling occurred on the site contrary to the <br />conditions of approval; and <br />WHEREAS, the Planning Commission found that automobile impound <br />storage has and is taking place on non-impervious <br />portion of the site contrary to the conditions of <br />approval of Case UP-86-7. <br />NOW, THEREFORE, THE PLANNING COMMISSION RESOLVES THE FOLLOWING: <br />Section 1. Directs the applicant to make a "good faith" effort <br />to apply for approvals and construct additional <br />impervious surface area for storage of impound <br />vehicles as follows: <br />a. That within 60 to 90 days of the effective date of <br />this resolution, all impound vehicle storage shall <br />be conducted on an impervious surface, satisfactory <br />to the City Engineer. <br />b. That the storm drainage for this site shall be <br />Conveyed to a storm drainage system protected by an <br />oil separator, the design of which is satisfactory <br />to the City Engineer. <br />Section 2. This resolution shall become effective <br />15 days after its passage and adoption. <br />._ <br />
