CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 91-149 <br />RESOLUTION AGREEING TO THE EXCHANGE OF <br />PROPERTY TAX REVENUES FOR ANNEXATION NO. 139 <br />(ROTTINGER HILLS) <br />WHEREAS, Section 99 of the Revenue and Taxation Code (AB 8) <br />provides, among other things, that no local agency <br />jurisdictional change can be completed without the <br />agencies affected by such change first having agreed upon <br />an exchange of property tax revenue between and among the <br />affected agencies; and <br />WHEREAS, the Alameda County Mayors' Conference, the City of <br />Pleasanton (Resolution No. 80-74) and the Alameda County <br />Board of Supervisors (Resolution No. 186574) have agreed <br />to a method for equitably distributing the property <br />taxes; and <br />WHEREAS, such specific annexation needs a resolution from both the <br />City and County agreeing to the exchange of property tax <br />revenues for the annexation to be completed and filed <br />with the State; <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br />Section 1: That for Annexation No. 139 (Kottinger Hills) by the <br />City of Pleasanton, which will be first effective for the <br />fiscal year following the filing of the Certificate of <br />completion with the State Board of Equalization providing <br />the filing occurs prior to December 31 of the preceding <br />year, the Auditor-Controller of the County of Alameda <br />shall be directed to cause an exchange of property tax <br />revenues pursuant to the provisions of Paragraphs No. 1 <br />and 3 of the attached City/County agreement. <br />Section 2: The City of Pleasanton certifies that: <br />There is no significant commercial and/or industrial <br />development on the proposed annexation. <br />Section 3: That the property tax proceeds accruing for the <br />Structural Fire Fund shall be transferred to the City of <br />Pleasanton. <br />Section 4: This resolution shall become effective immediately <br />upon its passage and adoption. <br />
