PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION N0. PC-89-37 <br />RESOLUTION APPROVING CASE UP-89-8, THE APPLICATION OF <br />STANLEY AND CAROLEE CARROLL <br />WHEREAS, Stanley and Carolee Carroll have applied for a <br />conditional use permit to serve alcoholic beverages <br />after 10:00pm on the site of an approved restaurant <br />located at 7300 Embarcadero Court in the Stoneridge <br />Corporate Center; and <br />WHEREAS, zoning for the property is PUD (Planned Unit <br />Development) - Commercial and Offices District; and <br />WHEREAS, at their duly noticed public hearing of March 22, 1989, <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br />WHEREAS, the Planning Commission made the following findings: <br />A. That the proposed location of the conditional use <br />is in accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br />The subject site is located in the Stoneridge PUD- <br />C/0 zoning district. Restaurants are a permitted <br />use in the Commercial zoning district and are in <br />accordance with the purposes of the zoning <br />ordinance to provide appropriate locations to offer <br />commodities and services to residents of the city <br />and its surrounding areas. The conditional use <br />permit for the service of alcoholic beverages at <br />Marie Callender's continues in accordance with the <br />objectives of the zoning ordinance and the purpose <br />of the district. <br />B. That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br />-1- <br />
