CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 91-146 <br />RESOLUTION VACATING A PORTION OF EL CAPITAN <br />DRIVE <br />WHEREAS, on September 3, 1991, the City Council received a staff <br />report (SR 91:351) recommending vacation of a portion of <br />El Capitan Drive, more particularly described in Exhibit <br />"A" attached hereto and by this reference incorporated <br />herein; and <br />WHEREAS, this portion of E1 Capitan Drive is no longer needed for <br />present or future street use due to its steep slope; and <br />WHEREAS, access will not be cut off to any person's property which <br />adjoins the portion of the street to be vacated; and <br />WHEREAS, no public service easements shall be terminated as a <br />result of the proposed vacation; <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br />Section 1: Pursuant to Chapter 4, Streets and Highway Code, and <br />based upon the findings stated above, a portion of El <br />Capitan Drive, as described in Exhibit "A", is hereby <br />vacated. <br />Section 2: The City Clerk shall cause a certified copy of this <br />resolution of vacation to be recorded in the office of <br />the Alameda County Recorder, subject to the condition <br />that City of Pleasanton Lot Line Adjustment 91-2 be <br />recorded concurrently. <br />Section 3: This resolution shall become effective immediately <br />upon its passage and adoption. <br />I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON SEPTEMBER 3, 1991 BY THE FOLLOWING VOTE: <br />AYES: Councilmembers - Butler, Mohr, Scribner, Tarver, and <br />Mayor Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />APPROVED AS TO FORM: <br />Michael H.
