A <br />certification from the consultant shall be provided to the <br />Director of Planning showing that the exterior noise level <br />does not exceed 70 dBA at the property line. If the noise <br />level exceeds this standard, then the Director of Planning may <br />refer the subject project back to the Planning Commission for <br />review at a public hearing. The Planning Commission may at <br />that time attach new conditions as necessary to <br />eliminate/minimize the problem. <br />3. In the event complaints are received by the Planning Director <br />regarding littering, loitering, noise, odors, panhandling, <br />harassment of patrons, or other problems occurring on the <br />site, the Director of Planning may refer the subject project <br />back to the Planning Commission for review at a public <br />hearing. The Planning Commission may at that time attach new <br />conditions as necessary to eliminate/minimize the problem(s). <br />4. Approval of design review application Z-90-74 by the City <br />Council is required for this development to proceed. If the <br />design review application fails to be approved, then UP-90-5 <br />shall expire immediately having no further force or effect. <br />5. The applicant shall pay to the City the sum of $27,000.00 for <br />the project's pro rata share of the cost of improvements to <br />the intersection of Hopyard Road and Owens Drive. Payment <br />shall be made prior to the issuance of building permits to the <br />satisfaction of the City Engineer. <br />
