<br />r <br /> <br /> <br />4m <br /> <br />'- <br /> <br />- <br /> <br />pLEASANTONc <br /> <br />SUBJECT <br /> <br />City Council <br />Staff Report <br /> <br />December 19,2006 <br />City Attorney <br /> <br />PURCHASE AGREEMENT FOR THE CITY'S ACQUISITION OF <br />THE PLEASANTON MEMORIAL GARDENS CEMETERY <br /> <br />STAFF RECOMMENDATION <br /> <br />SUMMARY <br /> <br />Authorize the City Manager to sign the attached Purchase Agreement. <br /> <br />In September 2006, City Council authorized staff to proceed with the <br />acquisition of the Pleasanton Memorial Gardens Cemetery on Sunol <br />Boulevard in south Pleasanton, with the understanding that if the City <br />purchased the property, the property would be maintained at the Pioneer <br />standard. To that end, staff has ordered a Phase I environmental analysis of <br />the site, has ordered an appraisal of the property, and has been negotiating <br />with an organization called Catholic Funeral & Cemetery Services to <br />provide funeral services and records management for plots on the property <br />already sold. (It is anticipated that an operating agreement will be in effect <br />when the City acquires the property.) Attached is a Purchase Agreement <br />that has been signed by representatives of the owner of the property. If <br />Council authorizes the Manager to sign the Agreement, the City would <br />proceed to purchase the property for one dollar by the end of January 2007, <br />assuming that nothing shows up in the Phase I analysis or title report of the <br />property that would cause Council to reconsider its decision. <br /> <br />Honorable Mayor and Members of the City Council: <br /> <br />BACKGROUND <br /> <br />The Pleasanton Memorial Gardens Cemetery, located at 5780 Sunol Boulevard, is owned and <br />operated by the Trustees of Pleasanton Lodge No. 255 of the Independent Order of Odd <br />Fellows. The organization for some time had expressed an interest in selling the site.
