PC-90-99 <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT AS FILED UNDER <br />CASE UP-90-50 AND A VARIANCE AS FILED UNDER CASE V-90-19 FOR <br />JOHN AND GINA TOMPRINS ~~',' , ~ ". ,~ ~> r .`~ <br />WHEREAS, John and Gina Tompkins have applied for (1) a conditional <br />use permit to legalize the conversion of a two-car garage <br />into a secondary unit and (2) variance approval to allow <br />a covered carport to encroach within the required <br />sideyard setback, and allow a required parking space <br />within the required frontyard setback; and <br />WHEREAS, zoning for the property is R-1-6500 (Single-family <br />Residential) District; and <br />WHEREAS, at their duly noticed public hearing of October 24, 1990, <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br />WHEREAS, the Planning Commission made the following findings: <br />Conditional Use Permit <br />A. That the proposed location of the conditional use <br />is in accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br />This request to establish a secondary unit in a <br />single-family residential district conforms with <br />the objectives of the Zoning Ordinance and to the <br />purpose of the single-family zoning district. The <br />proposed secondary unit would maintain the physical <br />single-family character of the neighborhood due to <br />its small size and its integration with the <br />existing house. There is concern with the <br />maintenance of the single-family lifestyle of the <br />neighborhood. Depending on who purchases the <br />property, the primary residence and the secondary <br />unit could be rented as separate dwelling units. <br />This situation would begin to impart multi-family <br />characteristics on the neighborhood. In order to <br />prevent this situation from happening, a condition <br />on any project approval is added which requires <br />that either the primary residence or the secondary <br />unit be owner-occupied. <br />B.
