A motion was made by Commissioner Horan, seconded by Commissioner <br />Hovingh finding that the proposed ,PUD rezoning is consistent with <br />the General Play; making the PUD findings for the proposed <br />development plan as listed in the staff report; and recommending <br />approval of Case PUD-90-10 subject to the conditions of the staff <br />report with the following modifications: <br />That Condition 8 be modified to reflect: that a concerted <br />effort between the developer and the City be made to get two <br />additional units of the 22 units at a target price as close <br />to the moderate income level as possible but lower than <br />$210,000; that Condition 8 be modified to allow a minimum of <br />l00 or 2 of the units shall be sold to buyers whose incomes <br />do not exceed the "moderate income" level, etc. The goal of <br />the moderate income program shall be to provide an <br />additional 2 units at the lowest possible price; that the <br />City agrees to waive all City fees. on the 2 moderate income <br />townhouses and will defer the fees on all the units until <br />sale as consideration for the developer's participation with <br />the City in minimizing the sale price of the 2 additional <br />units. <br />That Condition 7 be modified to say that the developer <br />continue to make an effort to work with the Vintage Hills <br />shopping center, if feasible, to provide access to the <br />center. <br />That Condition 9 be modified so that the wall does not <br />employ the use of plexiglass; the height of the wall to be <br />somewhere between 3 1/2 and 4 1/2 ft. Height should not <br />allow a view of seated residents when driving by.
