PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION N0. PC-90-50 <br />RESOLUTION DENYING THE APPEAL AS FILED UNDER CASE AP-90-06, <br />THEREFORE UPHOLDING THE APPROVAL OF CASE Z-89-758 AS <br />APPROVED BY THE DESIGN REVIEW BOARD FOR CHARLES AND MARY <br />CLAYTON <br />WHEREAS, the Planning Commission appealed a decision of the <br />Design Review Board which approved the construction of <br />a custom single-family home located at 2010 Valley Oak <br />Road (Lot 4, Tract 5945); and <br />WHEREAS, zoning for the property if PUD (Planned Unit <br />Development) - Low Density Residential District; and <br />WHEREAS, at their duly noticed public hearing of June 13, 1990, <br />the Planning Commission considered all public <br />testimony, relevant exhibits and recommendations of the <br />City staff concerning this application; and <br />WHEREAS, projects of this nature are categorically exempt from <br />the requirements of the California Environmental <br />Quality Act; and <br />WHEREAS, the proposed residential unit is consistent with the <br />approved Planned Unit Development. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br />Section 1. Upholds the decision of the Design Review Board <br />which approved Case Z-89-758, thereby denying the <br />appeal as filed under Case AP-90-6. Approval of <br />Case Z-89-758 is hereby granted subject to the <br />following conditions: <br />1. That the development shall be substantially as <br />shown on Exhibit "A", dated "Received April 7, <br />1990," on file with the Planning Department. <br />2. That all applicable City permits for the residence <br />shall be obtained prior to the commencement of <br />construction. <br />3. That the applicant shall increase the street side <br />yard fencing setback from 10 feet to the distance <br />required by any subsequently-approved fencing <br />guidelines, provided they are adopted prior to the <br />installation of the fence. <br />
