EXHIBIT B <br />CONDITIONS OF APPROVAL <br />PUD-58 and PGPA-11, Austin Property <br />3459 Old Foothill Road <br />October 17, 2006 <br />Project-Specific Conditions: <br />1. The subdivision, public improvements and landscaping, and buildings covered by <br />this approval shall be constructed/installed substantially as shown on the <br />development plans, Exhibit A, dated "Received August 18, 2006" on file with the <br />Planning Department, except as modified by the following conditions. Minor <br />changes to the plans may be allowed subject to the approval of the Planning <br />Director if found to be in substantial conformance to the approved exhibits. <br />2. The design, construction, and landscaping of the development covered by this <br />approval including the individual homes shall be subject to the following design <br />guidelines to the satisfaction of the Planning Director: <br />a. "Meadowlark Estates Subdivision Site Development and Architectural <br />Review Guidelines", dated August 11, 2006 or as subsequently revised by <br />City approval, prepared by Gorny & Associates and PGAdesign. <br />b. "Landscape Design Guidelines for Meadowlark, Austin Property", dated <br />May, 2006 or as subsequently revised by City approval, prepared by <br />PGAdesign. <br />The project developer shall work with staff to further refine the guidelines for <br />clear guidance to future owners regarding all aspects of the designs of these <br />homes. The guidelines shall state the design review procedures for these lots for <br />approval by the Zoning Administrator and shall state the procedures to inform the <br />Planning Commission of the Zoning Administrator's actions. The guidelines shall <br />state that the colors of the custom homes shall be consistent with the colors of <br />the existing environment in the Foothill area. The revised guidelines shall be <br />subject to review and approval by the Planning Commission with its action on the <br />tentative subdivision map. <br />3. The project developer shall pay any and all fees to which the properties covered <br />by this PUD Development Approval are subject prior to issuance of building <br />permits. The developer is exempt from the City's in-lieu park dedication fee. The <br />type and amount of the fees shall be those in effect at the time the building <br />permit is issued. <br />
