<br />granted the rights and remedies of the association, but not the obligation, to <br />enforce the maintenance responsibilities of the property owners association. <br /> <br />45. The project developer shall show with the tentative subdivision map application <br />the building setback lines conditioned by this approval superimposed on the lots. <br /> <br />46. The CC&R's for the project shall prohibit the parking of boats, campers, and <br />trailers on Lots 1 through 8. <br /> <br />47. Prior to recordation of the final subdivision map, all modifications required to the <br />design guidelines through conditions of approval shall be combined into a single <br />comprehensive document. This document shall be submitted to the Planning <br />Director for review and approval prior to publication. The project developer or its <br />successor in interest shall disclose the design guidelines to the lot buyers prior to <br />close of escrow, and shall provide them with copies of the guidelines. <br /> <br />48. The project developer shall prepare maintenance agreements for the shared <br />driveway including the culvertslbridges. The agreements shall be submitted to <br />the City Attorney for review and approval before City Council approval of the first <br />final subdivision map for this development and shall be recorded over the project <br />site by separate instrument. <br /> <br />49. The recorded deed of sale for all lots covered by this PUD Development Plan <br />approval shall include the following: <br /> <br />a. A disclosure stating that the City of Pleasanton intends to develop and <br />operate the Alviso Adobe Park, a City park, and that the buyer recognizes <br />that the activities that take place in the Alviso Adobe Park may result in <br />noise, odors, dust, traffic or other conditions that may affect the lots <br />covered by this PUD Development Plan. <br /> <br />b. A disclosure stating that the City of Pleasanton owns the open space area <br />surrounding Lots 1 through 8, that the open space area can be used by <br />the public, that the open space area may include a trail which would <br />connect to the Pleasanton Ridge trail, and that the buyer recognizes that <br />the activities that take place in the open space area may result in noise, <br />odors, dust, or other conditions that may affect the lots covered by this <br />PUD Development Plan. <br /> <br />c. A disclosure indicating the presence of the subdrains and cleanouts and <br />that it is the responsibility of the homeowner to relocate the subdrains if <br />encountered during the excavation of a pool or other subsurface structure. <br /> <br />d.
