<br />ORDINANCE NO. 1942 <br /> <br />AN ORDINANCE APPROVING THE APPLICATION OF CHARLES AUSTIN AND <br />SCOTT AUSTIN FOR PUD REZONING AND DEVELOPMENT PLAN APPROVAL, <br />AS FILED UNDER CASE PUD-58 <br /> <br />WHEREAS, Charles Austin and Scott Austin have applied for PUD rezoning and <br />development plan approval to rezone an approximately 30-acre hill property located at <br />3459 Old Foothill Road from A (Agriculture) District to PUD-LDR (Planned Unit <br />Development - Low Density Residential) District, maximum of eight dwelling units, on <br />eight acres and to PUD-OS/AG (Planned Unit Development - Open Space/Agriculture <br />and Grazing) Districts on the remaining 22 acres, and to subdivide the subject property <br />into eight custom home sites and 22 acres of permanent open space; and <br /> <br />WHEREAS, based on the Initial Environmental Study, a Negative Declaration <br />was adopted by the City Council on October 17, 2006; and <br /> <br />WHEREAS, at its meeting of October 17, 2006, the City Council received the <br />Planning Commission's positive recommendations for approval of the PUD rezoning <br />and development plan; and <br /> <br />WHEREAS, a duly noticed public hearing was held on October 17, 2006; and <br /> <br />WHEREAS, after a review of the materials presented, the City Council <br />determined that the proposed rezoning is appropriate for the site; and <br /> <br />WHEREAS, the City Council finds that the proposed PUD rezoning and <br />development plan are consistent with the General Plan policies of the City of <br />Pleasanton and the purposes of the PUD ordinance. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br /> <br />Section 1. Approves the rezoning of an approximately 30-acre hill property located at <br />3459 Old Foothill Road from A (Agriculture) District to PUD-LDR (Planned Unit <br />Development - Low Density Residential) District on eight acres and to PUD-OS/AG <br />(Planned Unit Development - Open Space/Agriculture and Grazing) Districts on the <br />remaining 22 acres, as shown on the attached Exhibit C, dated October 17,2006, and <br />incorporated herein by this reference. <br /> <br />Section 2. The Zoning Map of the City of Pleasanton, dated April 18, 1960, on file <br />with the City Clerk, designating and dividing the City into zoning districts, is hereby <br />amended by Zoning Unit Map No. 466, attached hereto as Exhibit A, dated October 17, <br />2006, and incorporated herein by this reference. <br /> <br />. <br />
