<br />1.01 PERSON. As UHf'd In this or-
<br />dinance "Person" means all dom-
<br />estic and foreign corporations. asso-
<br />elations, s)'ndicates. Joint stock cor-
<br />poratlon~, partnerships of every
<br />kind, clubs, trusts, societies and in-
<br />dividuals, transaotlng and carrying
<br />on any business in the City of
<br />Pieasanton.
<br />1.02 CITY. City shall mean the
<br />City of Pleasanton, County of Ala-
<br />ml'da. State of California.
<br />1.03 PIXED PLACE OF BUS-
<br />Inf'ss. For the purpose of this ordin-
<br />ance, the words "fixed place of
<br />business" shall mean the premises
<br />in the City of 1'Ieasanton accupied
<br />for the particular purpo:;\e of con-
<br />ducting the business then'at, and
<br />regularly kept open for the pur-
<br />pose with a competent person In
<br />atlendant'e for the purpose of at-
<br />tendlnK to ~uch business,

<br />ordinance, the word "collector shall
<br />mean ,the license collector of the
<br />City of Pleasanton, the City Admin~
<br />Istr-ator, or his duly authorized
<br />agr~~s'CANVASSER AND SOI.ICl-
<br />TOil. As used in this ordlance "can-
<br />,-asser and solicitor" shall mean any
<br />person whether as agent or prin-
<br />ciple who solicits, canvasses or
<br />takl's orders from house to hOU3e,
<br />from place to place in the city, for
<br />any goods. warel'l or merchandise
<br />or any article to he delivered gome
<br />time In the future, or for services
<br />to be performed in the futUre, or
<br />milking, munufacturing or repalr-

<br />Section 2.00 REVENUE MEAS-
<br />Ultl'-;:
<br />2.01 This ordinance Is enacted
<br />primarily to raise revenue for mun-
<br />icipal purposes and Is not intend-
<br />ed for regulation,
<br />Section 3,00 LICENSE REQUIR-
<br />ED:
<br />3.01 There are hereb~' imposed
<br />upon the businesses specified In this
<br />ordinance license taxes in the am-
<br />ounts hereafter prescribed, and it
<br />shall be unlawful for any person
<br />to transl\ct and carryon any busI-
<br />n('sses in the City of Pleasanton
<br />without first having procured a
<br />license from said City so to do
<br />Or without complying with any and
<br />an applicable prOVisions of this
<br />ordinance, and I'ach day such busi-
<br />ness Il'I carried on without a license
<br />shaH constitute a separate violation
<br />of this ordinance.
<br />Section .\.00 I,ICE~SE-A DEnT:
<br />.1.01 The amount of any ltcenl'le
<br />imposed b,. this ordinance shalt be
<br />deemed a iteM to the C!.t)" of I'leas-
<br />anton, and any person carrying on
<br />any business mentioned in this ordi-
<br />nance without havln", a license from
<br />said city gO to do, shalt be liable to
<br />an action In ,the name of !:'<ald city In
<br />any court of competent jurisdiction,
<br />for the amount of IIcen!:'<e by this
<br />ordinance imposed on such business.

<br />Section 5.00 DUTY OI>' COLLEC~
<br />TOR:
<br />5.01 It shall be the Collector's
<br />duty to prepare and Issue a license
<br />under t-hls ordinance for every per.
<br />son liable to pay a license here-
<br />under. and to state in each license
<br />the amount thereof, the period of
<br />time coverf'd therby, the name of
<br />the person to whom Issued, the type
<br />of business IIcensel and the location
<br />or place wht>re such business Is to
<br />be carrll'd on,
<br />It shall further be the dllty and
<br />rJ'sponslbilitv of the Collector to
<br />see t-hat all new buslne!:,<ges are
<br />Iil'ensed and thR.t all changes In
<br />location and status are recorded,
<br />Section 6.00 TRANSFER:

<br />Section 7.00 PAYMENT OF Ll-
<br />CI':NSE TAX:
<br />7.01 All license taxes shall be paid
<br />In advance at the office of the Col.
<br />lector.
<br />7.02 Any perSOn carrying on, eith-
<br />er as principal or agent, any busi-
<br />ness In said city not herein specif.
<br />iClllly set forth shall pay the amount
<br />of the license tax prescribed herein
<br />prOVided for the business nearest
<br />corresponding to the nature of the
<br />business sought to be licensed. as
<br />determined bv the Collector.
<br />7.03 The annual license taX' In

<br />8.01 Every person required to
<br />have a license under the provisions
<br />of this ordinance shall make appli-
<br />cation for the same to the Collector
<br />of t-he City, and Upon payment of
<br />the pn'scribed tax. the Collector
<br />shall issue to such person a license,
<br />unless such licence faits within a
<br />classification requiring approval of
<br />the City Council.

<br />issued under this ordinance, or for

<br />for his guidance In ascertaining the
<br />amount of licem.e tax to be paid hy
<br />the applicant, a written statement
<br />upon a form provided by the CoJlI'C-
<br />tor. signed by the applicant. of such

<br />tax to be paid by the applicant.

<br />Section 10.00 CHARItABLE OR-
<br />GANIZATIONS:
<br />18.01 Provisions of this ordinance
<br />

<br />shall not be deemed to require the
<br />payment of the license fee to con-
<br />duct, manage or carryon any ibusI~
<br />ness, occupation or activity from
<br />any institution or organIzation
<br />which is conducted or carried on
<br />wholly for the benefit of chari.
<br />table purposes, or from which prof-
<br />H Is not derived. either direetiy or
<br />indlrecti)., by any individual, firm
<br />or corporation.
<br />18.02 No license fee shall be re-
<br />quired for conducting any entertain-
<br />ment, concert, exhibition or lecture
<br />on scientific. historical, literary, re-
<br />ligious or moral subjects, within
<br />the City whenever the receipts of
<br />such activities are to be appropriat-
<br />ed to any church or school or to
<br />any religious or benevolent pur~
<br />pose.
<br />Section 19.00 DISABLED VET-
<br />EHANS:
<br />19.01 Every honorably dl!'lcharged
<br />or honorably released member of
<br />the Armed }l"'orces of the United
<br />States of America, who Is physically
<br />unable to ohtaln a IIvllhood by man-
<br />ual labor, and who shalt be a qualt-
<br />fied elector of the State of Cali-
<br />fornia. shall have the right to dls-
<br />trlhute circulars, to hawk, peddle
<br />and vend an)' lawful goods or wares
<br />other than intoxicating liquors,
<br />without payment of any license fee
<br />whatsoever,
<br />19.02 The license collector shall
<br />J!'lsue to such veteran, without cost,
<br />a free license, provided such vet-
<br />er(~,) :Makes application for such
<br />free license with the Collector.
<br />(Il) Exhibits to the Collector a
<br />certificate of disability as provided
<br />,by the Armed }l"'orces of Veterans
<br />Administration, and certificate of
<br />honorable dlschllrge or release from
<br />any of the Armed Forces of the
<br />United States of America.
<br />(c) Identifies himself by signa-
<br />ture to the Chief of Police or his
<br />representative.
<br />Sl:'ctlon 20.00 APPEAL:
<br />20.01 Anv person aggrie"ed hy any
<br />decision or an admlnlst mttve officer
<br />or agency with respect to the issu-
<br />ance or refusal to issue such lic-
<br />ense may appeal to the council by
<br />filing a notice of appeal with the
<br />Clerk of the Council. The Council
<br />shall thereupon fix a time and place
<br />for hearlnK of such appeal. The

<br />respective beats liable to pay a
<br />license, and see that such licenses
<br />are taken out, and shall have and
<br />exercise the power:
<br />First: to make arrests far the vi-
<br />olation of any of the prOVisions
<br />of this ordinance.
<br />Second: To enter free of charge,
<br />at anv time, any place of business
<br />for ,vhlCh a license Is reqUired by
<br />this ordinance and to demand the
<br />exhibition of such license for the
<br />current term bv any person en-
<br />gaged or employed in the transac-
<br />tion of such business, and If such
<br />pcrson shall then and there fall to
<br />exhibit such license ,such person
<br />shaH be liable to the penalt). pro-
<br />vided for a violation of this ordin-
<br />ance.
<br />Section 22.00 PENALTY FOR VI.
<br />OI~ATI0N:
<br />22.01 Any person viOlating any
<br />of t.he provisions of this ordinance.
<br />or knowingly or intentionally mis-
<br />representing to anv officer or em-
<br />ployee of thl!:'< city any material
<br />fact to procuring the license or
<br />permit herein pro\"lded for. shall
<br />be deemed Kuilty of a misdemean-
<br />or, and upon conviction thereof
<br />Mhall be punlshahle hy a fine of
<br />not more than Five Hundred Dol-
<br />lars ($500.00) or by imprisonment
<br />In the county jail for a period of
<br />not more than six month!'!, or by
<br />both such fine and Imprisonment.
