<br />RESOLUTION NO. 06-Cl67 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON APPROVING A <br />NEGATIVE DECLARATION FOR THE APPLICATION OF CHARLES AUSTIN AND SCOTT <br />AUSTIN FOR GENERAL PLAN AMENDMENT AND PUD REZONING AND DEVELOPMENT <br />PLAN APPROVAL, AS FILED UNDER CASE PGPA-11/PUD-58 <br /> <br />WHEREAS, at its meeting of October 17, 2006, the City Council received a proposed <br />Negative Declaration for the application of Charles Austin and Scott Austin for: (1) General Plan <br />amendment to change the land use designation of an approximately 30-acre hillside property <br />located at 3459 Old Foothill Road from Rural Density Residential (1 du/5 ac) to Low Density <br />Residential (<2 du/ac) on approximately eight acres with a maximum of eight units and to Open <br />Space/Agriculture and Grazing on the remaining 22 acres; and (2) PUD rezoning and <br />development plan approval to rezone the property from A (Agriculture) District to PUD-LDR <br />(Planned Unit Development - Low Density Residential) District on eight acres and to <br />PUD-OS/AG (Planned Unit Development - Open Space/Agriculture and Grazing) Districts on <br />the remaining 22 acres, and to subdivide the subject property into eight custom home sites and <br />22 acres of permanent open space; and <br /> <br />WHEREAS, the City Council received and reviewed the Initial Study, dated June 7, 2006 <br />and received the recommendations of staff and the Planning Commission; and <br /> <br />WHEREAS, a duly noticed public hearing was held on October 17, 2006, at which time <br />the public was given the opportunity to comment on the environmental impacts of the proposed <br />project; and <br /> <br />WHEREAS, the City Council has reviewed the potential impacts in accordance with the <br />applicable state and local guidelines governing the preparation of Negative Declarations and <br />Environmental Impact Reports; and <br /> <br />WHEREAS, the City Council finds that the proposed project would not have any <br />significant adverse effects on the environment; and <br /> <br />WHEREAS, the City Council further finds that the proposed project will have no <br />potential for adverse impacts on the site's wildlife. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Pleasanton <br />the following: <br /> <br />Section 1. Approves the Negative Declaration for the application of Charles Austin and <br />Scott Austin (1) General Plan amendment to change the land use designation of an <br />approximately 30-acre hillside property located at 3459 Old Foothill Road from Rural <br />Density Residential (1 du/5 ac) to Low Density Residential (<2 du/ac) on approximately <br />eight acres with a maximum of eight units and to Open Space/ Agriculture and Grazing <br />on the remaining 22 acres; and (2) PUD rezoning and development plan approval to <br />rezone the property from A (Agriculture) District to PUD-LDR (Planned Unit <br />Development - Low Density Residential) District on eight acres and to PUD-OS/AG <br />(Planned Unit Development - Open Space/ Agriculture and Grazing) Districts on the <br />remaining 22 acres, and to subdivide the subject property into eight custom home sites <br />and to designate the remaining 22 acres for permanent open space. <br />
