RESOLUTION NO. 06-Cl67 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON APPROVING A NEGATIVE DECLARATION FOR THE APPLICATION OF CHARLES AUSTIN AND SCOTT AUSTIN FOR GENERAL PLAN AMENDMENT AND PUD REZONING AND DEVELOPMENT PLAN APPROVAL, AS FILED UNDER CASE PGPA-11/PUD-58 WHEREAS, at its meeting of October 17, 2006, the City Council received a proposed Negative Declaration for the application of Charles Austin and Scott Austin for: (1) General Plan amendment to change the land use designation of an approximately 30-acre hillside property located at 3459 Old Foothill Road from Rural Density Residential (1 du/5 ac) to Low Density Residential (<2 du/ac) on approximately eight acres with a maximum of eight units and to Open Space/Agriculture and Grazing on the remaining 22 acres; and (2) PUD rezoning and development plan approval to rezone the property from A (Agriculture) District to PUD-LDR (Planned Unit Development - Low Density Residential) District on eight acres and to PUD-OS/AG (Planned Unit Development - Open Space/Agriculture and Grazing) Districts on the remaining 22 acres, and to subdivide the subject property into eight custom home sites and 22 acres of permanent open space; and WHEREAS, the City Council received and reviewed the Initial Study, dated June 7, 2006 and received the recommendations of staff and the Planning Commission; and WHEREAS, a duly noticed public hearing was held on October 17, 2006, at which time the public was given the opportunity to comment on the environmental impacts of the proposed project; and WHEREAS, the City Council has reviewed the potential impacts in accordance with the applicable state and local guidelines governing the preparation of Negative Declarations and Environmental Impact Reports; and WHEREAS, the City Council finds that the proposed project would not have any significant adverse effects on the environment; and WHEREAS, the City Council further finds that the proposed project will have no potential for adverse impacts on the site's wildlife. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Pleasanton the following: Section 1.
