CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 92-192 <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br /> RESOLUTION AMENDING THE NORTH PLEASANTON <br /> IMPROVEMENT DISTRICT NO. 1 (NPID 1) ENGINEER'S <br /> REPORT REGARDING FRONTAGE IMPROVEMENTS ACROSS <br /> DSRSD LEASED U.S. ARMY PROPERTY <br /> the City Council has heretofore levied assessments and <br /> provided for the construction of improvements in <br /> Assessment District No. 1982-4, North Pleasanton <br /> Improvement District No. 1, City of Pleasanton, Alameda <br /> County, California; and <br /> the work of improvement is detailed in the Amended <br /> Engineer's Report dated July 16, 1985; and <br /> the city assumed responsibility for the cost ($454,000) <br /> of a portion of the project relating to the land leased <br /> by DSRSD from the U.S. Army until the proper funding <br /> source could be determined; and <br /> DSRSD has determined that its benefit derived from the <br /> improvement is minimal and therefore DSRSD will not <br /> participate in the funding; and <br /> Chapter 4.5 of the 1913 Act, Streets and Highway Code, <br /> permits Council to rescind the section of the Engineer's <br /> Report detailing the city's obligation to reimburse the <br /> district the $454,000; and <br /> the current surplus in the NPID 1 of $2.8 million will <br /> not be affected by this action nor will any property <br /> owner's assessments be affected. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br />Section 1: Council rescinds Section VI of the NPID 1 Engineer's <br /> Report which states that the city will reimburse $454,000 <br /> to the District. <br />Section 2: The city is hereby relieved of the responsibility to <br /> reimburse the NPID 1 for a portion of the improvements <br /> associated with the widening of Johnson Drive. <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
