CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 92-191 <br /> <br />RESOLUTION PERMITTING THE CITY OF PTmASANTON <br />TO JOIN IN AMICUS BRIEF FOR CENTEX v. CITY OF <br />VALLEJO <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />the League of California Cities Legal Advocacy Committee <br />has requested amicus support in the efforts to uphold the <br />legality of imposing an excise tax on development; and <br /> <br />the City Attorney has recommended to the City Council <br />that the City of Pleasanton be added to the amici curiae <br />brief, at no out-of-pocket expense to the local <br />taxpayers. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br /> The City Council hereby approves joinder of the City of <br /> Pleasanton in the amici curiae brief in the case of <br /> Centex v. City of Vallejo, such participation to be at no <br /> out-of-pocket expense to the City of Pleasanton. <br /> <br />Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> I HEREBy CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON OCTOBER 6, 1992 BY THE FOLLOWING VOTE: <br /> <br /> Councilmembers - Mohr, Scribner, Tarver, and Mayor Mercer <br /> None <br /> Councilmember Butler <br /> None ~ <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />APPROVED AS T~ <br />Michael H.
