WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 92-187 <br /> <br />RESOLUTION DENYING THE APPEAL AND UPHOLDING <br />THE PLANNING COMMISSION APPROVAL OF A <br />CONDITIONAL USE PERMIT FOR DENNIS 'LEROY <br />THOMSON AS FILED UNDER CASE UP-92-33 <br /> <br />at its meeting of August 12, 1992, the Planning <br />Commission approved Case UP-92-33, the application of <br />Dennis Leroy Thomson for a conditional use permit to <br />allow a 9,600 sq. ft. country western dance studio on the <br />approximately 5.09 acre Vintage Hills Shopping Center <br />site located at 3550 Bernal Avenue; and <br /> <br />zoning for the property is PUD (Planned Unit Development) <br />- C-N (Neighborhood Commercial) District; and <br /> <br />the City Council appealed this decision in order to <br />further review the application; and <br /> <br />a public hearing was held before the City Council on <br />September 15, 1992 at which time all pertinent testimony <br />and documents were reviewed; and <br /> <br />after a review of the material presented, the City <br />Council makes the following findings: <br /> <br />a® <br /> <br />That the proposed location of the conditional use <br />is in accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />One of the main objectives of the zoning ordinance <br />for any Neighborhood Commercial district is to <br />provide appropriately located areas for retail <br />stores, service establishments, amusement <br />establishments, and wholesale businesses, offering <br />commodities and services required by the residents <br />of the City and its surrounding market area. <br /> <br />The site of the proposed use is located within a <br />PUD-C-N District. Dance studios are conditionally <br />permitted in C-N districts as they provide a <br />service to the residents of Pleasanton in the form <br />of amusement and entertainment centers. The <br />proposed conditions of approval for the project <br />give the City the appropriate controls to ensure <br />that'the use does not have adverse impacts on the <br />surrounding properties. The use permit for the <br />proposed dance studio is, therefore, in accordance <br /> <br /> <br />
