<br />ATTACHMENT A <br />1. That the City has adopted a comprehensive General Plan that establishes policies to <br />protect the living environment of all residents of the community; <br /> <br />2. That for-sale multiple-unit residential projects differ from multiple-unit residential rental <br />projects in numerous respects such as limiting housing opportunities for low-income and <br />very-low income households, especially for the elderly and the handicapped; moreover, <br />some individuals do not desire to own their housing; accordingly, for the benefit of public <br />health, safety and welfare, for-sale multiple-unit residential projects, including those that <br />were approved as for-sale projects but were de facto rental projects, should be treated <br />differently from multiple-unit residential rental projects in order to protect the community; <br /> <br />3. That the City has adopted an Inclusionary Zoning Ordinance to enhance the public <br />welfare and assure that housing development attains the City's affordable housing goals by <br />increasing the production of residential units affordable to very-low, low- and moderate- <br />income households; <br /> <br />4. That the housing element of the General Plan establishes housing affordability goals <br />and programs for maintaining and developing new affordable housing as well as goals to <br />encourage the development and/or the retention of multiple-unit residential rental units; <br /> <br />5. That the City desires to maintain a relationship between multiple-unit residential rental <br />unit vacancies and condominium conversion projects to avoid social and economic <br />problems that can arise with a decrease in the variety of housing options, such as <br />increased rents, displacement of individuals and families, and increased use of <br />transportation infrastructure as more individuals are forced to live farther from their <br />employment, schools or families; <br /> <br />6. That the City desires to attain the target of 25% of all new housing be affordable to low- <br />and very-low income households as set forth in Program 13.8 of the General Plan Housing <br />Element. <br /> <br />17.04.040 Physical Standards. <br /> <br />A. Physical standards for condominium conversion projects shall be as follows: <br /> <br />1. The design, improvement and/or construction of a condominium conversion project shall <br />conform to, and be in full accordance with, all requirements of all locally adopted building, <br />fire, housing, and other construction codes, zoning provisions, planning and other <br />applicable local, state or federal laws or ordinances relating to protection of public health <br />and safety laws in effect on the date the notice of intent to offer a unit for sale pursuant to <br />Section 17.04.050 of this Chapter; provided, however, if the condominium conversion <br />project was approved initially as a common interest development project and constructed <br />to the common interest development standards then in effect, it shall be exempt from <br />meeting the common interest development standards in effect on date of approval. <br /> <br />2. The project CC&Rs shall be reviewed and approved by the City Attorney and shall <br />provide for the maintenance of the project's landscaping and other common areas and <br />facilities. <br /> <br />Page 3 of9 <br />
