<br />Chapter 17.04 <br />RESIDENTIAL CONDOMINIUM CONVERSIONS <br /> <br />ATTACHMENT A <br /> <br />17.04.010 Regulation of Residential Condominium Conversion Projects. <br /> <br />This chapter regulates the conversion of multiple-unit residential rental projects to a common <br />interest development, as that term is defined in the California Civil Code, whether such <br />developments are called condominiums, townhouses, community apartments, planned <br />developments, stock cooperatives, or any other name. This chapter also regulates the <br />conversion of a previously approved common interest development as defined in Section <br />17.04.020 B. 2. of this Chapter. No person shall cause such conversion to be made except as <br />provided in this chapter. This chapter does not apply to commercial or industrial condominium <br />conversion projects. <br /> <br />17.04.020 Definitions. <br /> <br />For the purpose of this chapter, the following terms shall be defined as follows: <br /> <br />A. "Common interest development" means a common interest development as defined in the <br />California Civil Code or any other similar project involving the right of exclusive occupancy <br />or separate ownership of individual units. <br /> <br />B. "Condominium conversion project" means <br /> <br />1. The conversion or subdivision of a multiple-unit residential rental project into a common <br />interest development; or <br /> <br />2. The conversion of a previously approved common interest development, in which more <br />than sixty-five (65%) of the units within the development have heretofore been rented, to a <br />project in which the residential units will be sold as individual units, unless the developer <br />has: <br /> <br />a. recorded a final subdivision map, Conditions, Covenants, and Restrictions <br />(CC&Rs) and a condominium plan; and <br /> <br />b. from the time of the City's approval of the development, obtained and <br />continuously maintained a final subdivision public report from the State Department <br />of Real Estate. <br /> <br />C. "Date of approval" means the date that the City Council approves a condominium <br />conversion project application. <br /> <br />D. "Developer" means the owner or subdivider with a proprietary interest in the proposed <br />condominium conversion project. <br /> <br />E. "Inclusionary Zoning Ordinance" means terms, definitions and requirements as set forth in <br />Chapter 17.44 of the Pleasanton Municipal Code, as said Chapter is amended from time to <br />time. <br />
